3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO.
4 14,835 (AUGUST 7, 2018) AND LITTLE ROCK,ARK.,RESOLUTION NO.
5 14,856 (SEPTEMBER 18, 2018), TO REFLECT THE PROPER ACCOUNT
6 AS TO THE SOURCE OF FUNDS;TO AUTHORIZE A CONTRACT WITH
7 RIVER CITY HYDRAULICS, INC., IN AN AMOUNT NOT TO EXCEED
8 THIRTY-FIVE THOUSAND, ONE HUNDRED EIGHTY DOLLARS
9 ($35,180.00), TO PROVIDE WARRANTIES FOR THE REAR-LOADER
10 SANITATION TRUCKS AUTHORIZED IN RESOLUTION NO. 14,835;
11 AND FOR OTHER PURPOSES.

13 WHEREAS,in August and September 2018,the Board of Directors approved two(2)resolutions for
14 the purchase of Rear-Loader Sanitation Trucks pursuant to Little Rock, Ark., Resolution No. 14,835
15 (August 7,2018),and Little Rock,Ark.,Resolution No. 14,856(September 18,2018); and,
16 WHEREAS,upon receipt of a statement from River City Hydraulics,Inc., it was determined that the
17 Warranty Agreements for all of these vehicles had not been officially authorized and should be; and,
18 WHEREAS, upon discovery of the warranty issue it was also determined that the account number
19 provided for the purchase of the trucks in August 2018, and September 2018, needed to be amended.
20 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. Section 2 of Little Rock,Ark.,Resolution No. 14,835 (August 7,2018)is hereby amended
23 to read as follows:
24 Funds for this purchase are available in Public Works Waste Disposal Fund Account No.
25 603110-72300.
26 Section 2. Section 2 of Little Rock, Ark., Resolution No. 14,856 (September 18, 2018) is hereby
27 amended to read as follows:
28 Funds for this purchase are available in Public Works Waste Disposal Fund Account No.
29 603009-72300-S40A560.
30 Section 3. The City Manager is authorized to enter into an agreement with River City Hydraulics,
31 Inc., of Sherwood, Arkansas, in an amount not to exceed Thirty-Five Thousand, One Hundred Eighty
32 Dollars ($35,180.00) for the purchase of Warranty Agreements for the Rear-Loader Sanitation Trucks
33 authorized for purchase in Little Rock,Ark.,Resolution No. 14,835 (August 7,2018).

1 Section 4. Funds for the warranty purchases set forth in Section 3 of this resolution are available in
2 Public Works Waste Disposal Fund,Account No. 603110-72300.
3 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
4 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adju-
5 dication shall not affect the remaining portions of the resolution which shall remain in full force and effect
6 as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the reso-
7 lution.
8 Section 6. Repealer. All laws,ordinances,resolutions,or parts of the same,including but not limited
9 to Little Rock,Ark.,Resolution No. 14,835 (August 7,2018)and Little Rock,Ark.,Resolution No. 14,856
10 (September 18,2018), inconsistent with the provisions of this resolution, are hereby repealed to the extent
11 of such inconsistency.
