HomeMy WebLinkAbout120181 2 RESOLUTION NO. 12,018 3 A RESOLUTION TO AUTHORIZE THE MAYOR AND THE 4 CITY CLERK TO EXECUTE DOCUMENTS NEEDED TO 5 CONVEY CERTAIN UNNEEDED RIGHT -OF -WAY LOCATED 6 ALONG KANIS ROAD IN THE CITY OF LITTLE ROCK, 7 ARKANSAS TO BAPTIST HEALTH; AND FOR OTHER 8 PURPOSES. 0 10 WHEREAS, the widening and realignment of Kanis Road between John Barrow 11 Road and I -430 was funded by the 1988 City General Obligation Bond Issue, and 12 WHEREAS, in 1991, the City began various discussions with involved parties 13 about the specifics of the future Kanis Road realignment, and 14 WHEREAS, in 1991, the board of directors of Baptist Health authorized an in- 15 lieu contribution of $135,000 for improvements to Kanis Road adjacent to the property 16 owned by Baptist Medical System, which was later raised to $200,000, and 17 WHEREAS, the proposed realignment of Kanis Road where it curved near 18 Baptist Medical Center also necessitated the City's acquisition of certain properties 19 belonging to Baptist Health and made certain right -of -way previously obtained by the 20 City on the other side of the existing road unnecessary, and 21 WHEREAS, as sought by the City, Baptist Health agreed in 1992 to the 22 dedication of properties for the needed right -of -way along the curve in exchange for 23 right -of -way to be abandoned by the City as a result of the realignment and 24 straightening of the roadway, and 25 WHEREAS, in 1997, Baptist Health provided the donation warranty deed and 26 various easements needed by the City for the construction of the Kanis Road [PAGE 1 of 51 Resolution To authorize conveyance of ROW to Baptist Health 1 realignment to the City at no charge to the City and paid the $200,000 in -lieu 2 contribution to the City in December, 1998, and 3 WHEREAS, it is proper and desirable for the City to deed the unneeded right - 4 of -way described in the attached legal description, as shown in Attachment A, and as 5 shown on the map on Attachment B attached hereto, in exchange for the right -of -way 6 already deeded by Baptist Health to the City as previously agreed by the parties. 7 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 8 THE CITY OF LITTLE ROCK, ARKANSAS: 9 Section 1. In accordance with a prior agreement about exchange of property 10 reached between Baptist Health and the City of Little Rock, the Mayor and City Clerk 11 are hereby authorized to execute a deed and any other necessary documents to convey, 12 in a form approved by the City Attorney, right -of -way property along Kanis Road, as 13 described in Attachment A and shown on the map on Attachment B attached hereto, to 14 Baptist Health. 15 Section 2. Severability. In the event any title, section, paragraph, item, sentence, 16 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 17 unconstitutional, such declaration or adjudication shall not affect the remaining 18 portions of the resolution which shall remain in full force and effect as if the portion so 19 declared or adjudged invalid or unconstitutional were not originally a part of the 20 resolution. 21 Section 3. Repealer. Being more particularly described as follows: Commencing at the Southeast Corner of said Lot 2, Baptist Medical Center Development; thence North 61 °57'12" West 600.05 feet to the POINT OF BEGINNING; thence along a curve to the left having a radius of 845.00 feet, an arc length of 242.81 feet and a chord which bears North 80 °28'26" West 241.97 feet; thence along a curve to the left having a radius of 372.08 feet, an arc length of 82.75 feet and a chord which bears North 86416'26" West 82.58 feet; thence South 8721'18" West 124.49 feet; thence South 79442'03" West 127.88 feet; thence South 85410'30" West 282.56 feet; thence North 72402'48" East 238.72 feet; thence North 79442'03" East 176.48 feet; thence North 87421'18" East 128.42 feet; thence along a curve to the right having a radius of 430.83 feet, an arc length of 230.78 feet and a chord which bears South 77417'57" East 228.03 feet; thence South 61457'12" East 114.78 feet to the POINT OF BEGINNING containing 36,653 square feet, more or less.
