RIGGS,IN AN AMOUNT NOT TO 6 EXCEED AN ANNUAL BUDGET OF ONE HUNDRED FORTY-FIVE 7 THOUSAND DOLLARS ($145,000.00), FOR AN ANNUAL CONTRACT 8 FOR CATERPILLAR PARTS AND SERVICE FOR THE FLEET 9 SERVICES DEPARTMENT; AND FOR OTHER PURPOSES. 10 11 WHEREAS, it is critical that the Fleet Services Department ("Fleet") be equipped with reliable 12 Caterpillar Parts and Service Tools for minor repairs and maintenance on Caterpillar Equipment currently 13 in the City's fleet;and, 14 WHEREAS,J.A. Riggs is the only authorized Caterpillar dealer in Central Arkansas;and, 15 WHEREAS,the Annual Purchase Order is for a one(1)-year term with two(2), one(1)-year renewal 16 options; and, 17 WHEREAS,the Annual Budget for each one (1)-year term is not to exceed One Hundred Forty-Five 18 Thousand Dollars($145,000.00). 19 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF '1'H] CITY 20 OF LITTLE ROCK,ARKANSAS: 21 Section 1. The Board of Directors hereby authorize the City Manager to enter into a one (1)-year 22 contract with not more than two (1), one (1)-year renewal extensions with J.A. Riggs for the purchase of 23 Caterpillar Parts and Service for an annual purchase amount not to exceed One Hundred Forty-Five 24 Thousand Dollars($145,000.00). 25 Section 2. The funding for the Annual Purchase Order is available in the various Fleet Maintenance 26 and Parts Accounts. 27 Section 3. Because J.A. Riggs is the only distributor for the Caterpillar Parts and Service meeting the 28 Departments specifications, the Board of Directors declares it is impractical and unfeasible to submit this 29 purchase to competitive bids. 30 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 31 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 32 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 33 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 34 ordinance.
