Andres, at 2115 Broadway, has requested that his property at this address be rezoned from "C''' -Two Family to "F" -Commercial, the hearing to be November 8, 18.62. It is my belief that spot zoning at this address would depreciate the value of my property, and other properties in the neighborhood, if this were allowed. I am opposed to rezoning any property on Broadway between 15th and 24th Streets to 'IFI' Commercial, and set out the following reasons: 1. When the South Bypass is completed the traffic count on Broadway will drop drastically and there will be very little demand for commercial properties on this street. 2. Broadway is by no means ready to go commercial as there is no particular demand for commercial property on this street. 3. If IIFII Commercial is the zoning, the majority of the property owners would be really damaged by the uses permitted. Certainly a Dairy Queen or an all night washateria would be extremely noxious in a residential neighborhood. 4. The highest and best use for this portion of Broadway in my opinion is multiple -family residential. One has only to drive up Broadway, commencing at 13th Street, to notice• the condition:pf the houses - the amount of vacant property-- the amount Of UNRENTED rentals - the general lack of repair - to know that Broadway is no longer the "strictly residential sectional so designated by the "Planners"- The high cost of remodeling old homes makes the proposition of con- verting our homes into apartments which we could, IF LUCKY, rent for only $45.00 to $75.00, out of the question. Also, with the giant apartment houses being built in the Park Plaza Sections, as well as in other sections (other than Broadway and vicinity) the already TOO LARGE RENTAL SECTION in the newapapers would grow to a ridiculous non-paying level. The action was tiled by appallses, Frederick U. Andres and his wife, Grace, to enjoin the Board of Directors of the City of Little Rock, its emp: oyees, comisalonere and agencies, frost preventing the plaintiffs frost using their property at 2115 Broadway, Little Rick, for purposes designated as "F Commercial" by the Little Rook Boning ordinances. The Chancellor granted the relief prayed and the City of Little Rock has appealed. The property involved in the horse of appellees and is located in an area designated in the zoning ordinances of Little Rock as "C-2 Family District". Appellees contend that Broadway in general, and the block in which their property is located in particular, is no longer suitable as a family district. They,, therefore, applied to the Little Rook Planning Commission to have the zoning on their property changed to eammercil; the Planning Comm"asion denied the requests appellees appealed to the Board of Directors of Little Rock and again the request was denied. 4 -6- Appellees have offered their property at 2115 Broadway, which they seek to rezone, for sale at $15,000 and a snot find a buyer. Mr. A.C. Head, the third person living on Broadway who testified against rezoning, is in the real estate business. He testified that appellees' lot would be worth $15,000 or $17,000 if rezoned, and that a.ppeile were going to tear downs a house located thereon tha-L w,) -,.,Id cost $35,000 to replace. In other words, the appellees can not get $15,000 for the lot with the on it, but can get $15,000 or $17,000 for• �..,= 31uitc,o�:t the house if it is zoned commercial. If a lot becomes vacant because the hoiisr- is condemned or is uestroyed by fire, it has no value unless the property can be rezoned as oommercial. An apartment house could not be built and rensted successf~ally because no parirAng is permitted on Broadway and one lot would not be large enough to take care of the required paric_i nr. — According to the undisputed evidence property on 1:�roadway would have a reasonable and satisfactory val,..:e as commercial property. In the case of Fentress v.
