HomeMy WebLinkAbout216761 ORDINANCE NO. 21,676 2 3 AN ORDINANCE TO AMEND CHAPTER 23, ARTICLE I, § 23-3 (FEES) 4 OF THE LITTLE ROCK REVISED CODE OF ORDINANCES (1988) TO 5 PROVIDE FOR THE MODIFICATION OF VARIOUS FILING FEES AND 6 PERMITS; TO DECLARE AN EMERGENCY; AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, the Planning & Development Department receives numerous requests for approval of site 10 plans, subdivisions and requests for changes in zoning; and, 11 WHEREAS, there is significant cost involved in the evaluation of these requests, publishing necessary 12 notices and making sufficient copies for the public and the relevant Commissions, Boards and Staff; and, 13 WHEREAS, there has been no change in the fees and permits for those requests in many years in spite 14 of rising costs. 15 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 16 OF LITTLE ROCK, ARKANSAS. 17 Section 1. That Chapter 23, Section 23 -3. (a) fees be amended to read as follows: 18 Rezoning. That Chapter 23, Section 23 -3. (b) fees be amended to read as follows: 22 (b) Subdivision Applications. The filing fees for submitting subdivision applications to the 23 office of the City Department designated by the City Manager shall be as follows: Parcel Size, Acres f+; Q g5� �Over�S t0103 ~,. That Chapter 23, Section 23 -3(c) fees be amended to read as follows: 2 (c) Site Plan Applications, etc. The filing fees for submitting site plan applications and other 3 matters listed below to the office of the City Department designated by the City Manager shall be 4 as follows: 5 (1) Subdivision Site Plan: 6 (a) $150.00 for residential sites under five (5) acres 7 (b) $275.00 for residential sites from five (5) acres to ten (10) acres (inclusive) 8 (c) $400.00 for residential sites over ten (10) acres 9 (d) $300.00 for nonresidential sites under five (5) acres 10 (e) $350.00 for nonresidential sites from five (5) acres to ten (10) acres (inclusive) 11 (f) $400.00 for nonresidential sites over ten (10) acres 12 (2) Zoning Site Plan: 13 .(a) $150.00 for residential sites under five (5) acres 14 (b) $275.00 for residential sites from five (5) acres to ten (10) acres (inclusive) 15 (c) $400.00 for residential sites over ten (10) acres 16 (d) $300.00 for nonresidential sites under five (5) acres 17 (e) $350.00 for nonresidential sites from five (5) acres to ten (10) acres (inclusive) 18 (f) $400.00 for nonresidential sites over ten (10) acres 19 (3) Conditional Use Permits: 20 (a) $175.00 for residential sites up to '/z -acre 21 (b) $200.00 for residential sites over V2 -acre and less than three (3) acres 22 (c) $275.00 for residential sites three (3) acres and larger 23 (d) $250.00 for nonresidential sites under three (3) acres 24 (e) $350.00 for nonresidential sites from three (3) acres to ten (10) acres (inclusive) 25 (f) $400.00 for nonresidential sites over ten (10) acres 26 (4) Board of Adjustment: Seventy -Five Dollars ($75.00) for Administrative Appeals 27 and Interpretations, One Hundred Dollars ($100.00) for single-family and two - 28 family variance applications, Two Hundred Fifty Dollars ($250.00) for multi- family 29 (more than two (2) dwelling units) and nonresidential variance applications and Sixty 30 Dollars ($60.00) for sign variance applications. 31 (5) Special Use Permit: One Hundred Seventy -Five Dollars ($175.00) for all sites. 32 (6) Tower Use Permits: 33 (a) $200.00 for all sites up to'/2-acre in area 34 (b) $300.00 for all sites between'/2-acre and five (5) acres in area 35 (c) $400.00 for all sites five (5) acres and larger [Page 2 of 31 I The land area of the ownership within which the tower lease site is 2 placed shall be the acreage used for determining the fee. 3 (7) Land Use Plan Amendments and other appeal, waiver or requests to modify a Master Plan 4 element shall be assessed a fee of Seventy -Five Dollars ($75.00). 5 (8) Street Name Change Applications: Two Hundred Dollars ($200.00) 6 (9) Easement Abandonment Applications: Two Hundred Dollars ($200.00) 7 (10) Wireless Communication Facility Application Plan Review: One Hundred Fifty Dollars 8 ($150.00) 9 (11) Historic District Commission Certificate of Appropriateness: One Hundred Dollars 10 ($100.00) 11 Section 4. That Chapter 23 Section 23 -3. (d) fees be amended to read as follows: 12 (d) Planned Zoning District Applications. That all other provisions of Chapter 23 of the Code of Ordinances not in conflict with this 17 ordinance shall remain in full force and effect. 18 Section 6. Emergency. The ability to regulate proper land use and zoning is essential to the public 19 health, safety and welfare, and further, requires an appropriate and consistent fee structure.
