HomeMy WebLinkAbout19469Ll 2 ORDINANCE NO. 19,469 3 AN ORDINANCE TO ABANDON AN UNDEVELOPED, 4 UNNAMED 20 FOOT BY 85 FOOT STREET RIGHT -OF -WAY 5 ADJACENT TO 11525 SUMMIT ROAD, IN THE CITY OF LITTLE 6 ROCK AS A PUBLIC RIGHT -OF -WAY; AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, a request was made to abandon a public right -of -way for an 10 undeveloped, unnamed 20 foot by 85 foot street right -of -way adjacent to 11525 Summit 11 Road, in the City of Little Rock, pursuant to the City's general police power authority 12 under Ark. Code Ann. § 14 -54 -104; 13 WHEREAS, the Board has determined that the abandoning of this public right - 14 of -way will not have an adverse impact on the adjacent property owners nor the local 15 traffic, and therefore, the right -of -way abandoned by this ordinance is no longer needed 16 for corporate purposes. 17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 18 OF THE CITY OF LITTLE ROCK, ARKANSAS: 19 Section 1. The Board of Directors hereby releases, vacates, and abandons the 20 portion of West 26th right -of -way located between Blocks 5 and 7, C.E Gallagher's 21 Addition, East of Booker Street, together with the right of public in general, in the City 22 of Little Rock, Pulaski County, Arkansas. 23 Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed 24 in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of 25 Pulaski County, Arkansas. 26 Section 3. Severability. In the event any title, section, paragraph, item, 27 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid [PAGE 1 OF 2] Ordinance To abandon a portion of an undeveloped, unnamed ROW 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was not originally a part of the ordinance. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
