HomeMy WebLinkAbout11971E RESOLUTION NO. 11,971 3 A RESOLUTION TO SET MAY 3, 2005, AS THE DATE FOR A PUBLIC 4 HEARING ON WHETHER TO ESTABLISH CHENAL VALLEY 5 MUNICIPAL PROPERTY OWNERS MULTI - PURPOSE 6 IMPROVEMENT DISTRICT NO. 10; AND FOR OTHER PURPOSES. 7 8 WHEREAS, property owners who claim to be all of the owners of record title of 9 real property located within a proposed municipal property owners improvement 10 district as described in Exhibit A, and 11 WHEREAS, a public hearing must be held prior to the creation of this district, 12 which is to be known as Chenal Valley Municipal Property Owners Multi- Purpose 13 Improvement District No. 10. 14 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 15 THE CITY OF LITTLE ROCK, ARKANSAS: 16 Section 1. The Board of Directors shall conduct a public hearing at 6:00 PM in 17 the Board Meeting Room on the second floor of City Hall at 500 West Markham, Little 18 Rock, Arkansas, on Tuesday, May 3, 2005, on the question of whether to approve the 19 creation of Chenal Valley Municipal Property Owners Multi- Purpose Improvement 20 District No. 10; all person wishing to be heard on this issue will be heard at that time. 21 Section 2. The basic description of the boundaries for this proposed district are 22 attached as Exhibit A to this resolution, and the basic list of improvements is attached as 23 Exhibit B. 24 Section 3. Severability. In the event any title, section, paragraph, item, sentence, 25 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 26 unconstitutional, such declaration or adjudication shall not affect the remaining 27 portions of the resolution which shall remain in full force and effect as if the portion so [PAGE 1 OF 51 1 declared or adjudged invalid or unconstitutional was not originally a part of the 2 resolution. 3 Section 4. Repealer. CONTAINING A NET OF 174.5 20 ACRES MORE OR LESS. 21 // 22 23 24 25 26 27 // 28 // 29 30 31 // 32 // 33 34 35 36 37 38 39 40 41 42 // 43 // [PAGE 4 OF 51 1 EXHIBIT B 2 3 Description of Improvements 4 5 Financing the cost of constructing public improvements including (i) constructing a 4,050 linear 6 feet extension of Rahling Road from Chenal Parkway to Kanis Road, and improvements to 7 Rahling Road and Chenal Parkway at the intersection thereof including construction of bridge and 8 weir improvements at the Rock Creek intersection, and improvements to Rahling Road and Kanis 9 Road at the intersection thereof; constructing a 1,950 linear feet extension of LaGrande Drive; a 10 650 linear feet extension of Champagnolle Drive; together with such other street and road 11 improvements incidental thereto as may be depicted in the map attached as Exhibit B; and to open, 12 grade, drain, pave, curb, gutter or otherwise improve such other streets, roads, highways, and every 13 other way for passage and use. of vehicles, and including sidewalks, pedestrian trails and 14 walkways, viaducts, underpasses and appurtenant lighting, either within or without the boundaries 15 of the district if the property of the district will be benefited thereby, and such purposes shall 16 include the acquisition of rights of way by purchase or the exercise of the power of eminent 17 domain; (ii) constructing water mains along various streets and roadways and additional water 18 mains at other locations within the District as may be depicted on the map attached as Exhibit B 19 and other appurtenant water improvements either within or without the boundaries of the District if 20 the property of the District will be benefited thereby; (iii) constructing sanitary sewer gravity mains 21 as may be depicted on the map attached as Exhibit B and other appurtenant sewer improvements 22 either within or without the boundaries of the District if the property of the District will be 23 benefited thereby; (iv) acquiring and constructing electric junction boxes, electric conduits, 24 underground power lines, street lighting and other electric utility improvements as may be depicted 25 on the map attached hereto as Exhibit B either within or without the boundaries of the District if 26 the property of the District will be benefited thereby; (v) all other purposes authorized by Ark. 27 Code Ann.
