HomeMy WebLinkAbout12168I 2 RESOLUTION NO. 12,168 3 A RESOLUTION TO AUTHORIZE THE ONE -TIME USE OF $582,000 OF GENERAL 4 FUND RESTRICTED RESERVE FUNDS IN ORDER TO PROVIDE MONIES TO PULASKI 5 COUNTY FOR THE 2006 OPERATIONS OF THE PULASKI COUNTY REGIONAL DE- 6 TENTION FACILITY; AND FOR OTHER PURPOSES. 7 8 WHEREAS, the Little Rock Board of Directors determined in a policy planning session that 9 public safety is the City's top priority, and 10 WHEREAS, the ability to achieve high effectiveness in public safety depends in large part 11 upon the availability of detention facilities to place persons arrested for, or convicted of, crimi- 12 nal offenses, and 13 WHEREAS, the County is mandated to provide for "the custody of persons accused or con - 14 victed of crime ..." in Ark. Code Ann. § 14- 14- 802(a)(2) (West 2004), and 15 WHEREAS, notwithstanding this mandate, the municipalities of central Arkansas and the 16 County entered into an agreement on February 15, 1990, to provide additional funding, and the 17 City of Little Rock authorized this agreement in Little Rock, Ark., Resolution No. 8257 (February 18 6, 1990), and 19 WHEREAS, the City has met its obligations pursuant to this agreement and, to date, has pro - 20 vided three million, five hundred and forty -eight thousand one hundred and ninety 21 ($3,548,190) dollars in additional funding to assist with jail operations, and 22 WHEREAS, Pulaski County has reported that anticipated revenues for 2006 will be insuffi- 23 cient to provide for jail operations despite the City's agreed contribution, and 24 WHEREAS, the Board of Directors believes that this one time expenditure from the City's 25 General Fund Restricted Reserve Fund is appropriate under the circumstances brought forward 26 in the last few weeks because it will help to assure continued operations of the jail at the great - 27 est population the County can reasonably afford to maintain, and [PAGE 1 OF 3] Resolution to authorize one -time 2006 funding for jail operations From City General Fund Restricted Reserve Fund 1 WHEREAS, the Board of Directors also wishes to participate with the County, and the other 2 cities within the County, to develop plans for proper, efficient, adequate, and effective jail op- 3 erations in the future, 4 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE 5 ROCK, ARKANSAS: 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Section 1. In addition to the monies required by the agreement approved in Little Rock, Ark., Resolution 8257 (February 6, 1990), and the additional monies already anticipated for the 2006 budget, the City Manager is authorized to include a one -time payment of five hundred and eighty two thousand ($582,000) dollars from the General Fund Restricted Reserve Fund for the operation of the Pulaski County Regional Detention Facility. Section 2. The one -time expenditure authorized in the preceding section is contingent upon the County contributing a minimum of an additional one hundred fifty thousand ($150,000) toward the operation of the jail, maintaining a minimum of 880 available beds at the jail and a commitment from the County Sheriff to meet with the Police Chiefs of the munici- palities to identify other options for housing persons convicted of misdemeanor offenses, in- cluding the possible use of existing facilities in North Little Rock, Sherwood and Maumelle. Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or uncon- stitutional was not originally a part of the resolution. Section 4. Repealer. All laws and parts of laws inconsistent with the provisions of this resolution are hereby repealed to the extent of such inconsistency.
