HomeMy WebLinkAbout21610 1 ORDINANCE NO. 21,610 2 3 AN ORDINANCE TO AMEND LITTLE ROCK, ARKANSAS, 4 ORDINANCE NO. 19,246 (DECEMBER 7, 2004) TO ADD THE 5 SEPTEMBER 2015 CAPITAL IMPROVEMENTS PLAN AS ADDITIONAL 6 PROJECTS TO BE INCLUDED IN THE PROJECT PLAN; TO 7 AUTHORIZE THE MAYOR AND THE CITY MANAGER TO PROVIDE 8 FUNDING OF TWO HUNDRED FIFTY THOUSAND DOLLARS 9 ($250,000.00) TO THE LITTLE ROCK PORT AUTHORITY TO PROVIDE 10 2018 TRACK MAINTENANCE; TO DECLARE AN EMERGENCY; AND 11 FOR OTHER PURPOSES. 12 13 WHEREAS, the Board approved the Project Plan in Section 5 of Little Rock, Arkansas, Ordinance 14 No. 19,246(December 7,2004); and, 15 WHEREAS,the Project Plan needs to be amended to include those projects described in the September 16 2015 Capital Improvements Plan of the Port of Little Rock Redevelopment District No. 2 of the City of 17 Little Rock, Arkansas, including improving any and all roads that are located within the Redevelopment 18 District; and, 19 WHEREAS, based upon the adoption of the plan, Little Rock Port Authority Staff requests Two 20 Hundred Fifty Thousand Dollars($250,000.00)for 2018 Annual Track Maintenance, consisting of; 21 1) Remove and replace 1,200 railroad ties along the harbor track with new wooden industrial 22 grade ties and spikes.The project was publicly bid and Trac-Work was the low bid at a cost of 23 One Hundred Twenty Thousand Dollars($120,000.00). 24 2) Upgrade 2,100 feet of existing rail from ninety (90) pound to 136 pound steel; improve the 25 turnout at the river terminal dock.The project was publicly bid and Trac-Work was the low bid 26 at a cost of One Hundred Eighty Thousand, Three Hundred Eighty-Eight Dollars 27 ($180,388.00). 28 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF LITTLE 29 ROCK,ARKANSAS: 30 Section 1. The Little Rock Board of Directors authorizes the Mayor and the City Manager to provide 11 funding of Two Hundred Fifty Thousand Dollars($250,000.00)to the Little Rock Port Authority to Provide 12 2018 Track Maintenance. 13 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 14 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 15 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 16 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 17 ordinance. 18 Section 4.Repealer. All laws, ordinances,resolutions,bylaws,and other matters inconsistent with this 19 ordinance, particularly including, but not limited to Little Rock, Arkansas, Ordinance No. 19,246 20 (December 7,2004),are hereby repealed to the extent of such inconsistency. 21 Section 5. Emergency Clause. The Board of Directors hereby determines that the Project Plans 22 authorized in this amended ordinance must be accomplished as soon as possible in order to obtain the funds 23 necessary to discourage the loss of commerce, industry, or employment and to increase employment in the 24 City and, therefore, an emergency is hereby declared to exist and this ordinance, being necessary for the 25 immediate preservation of the public peace, health, safety, shall take effect and be in full force and effect 26 from and after the date of its passage. 27 PASSED: August 7,2018 28 A_ _E • APPROVE . 29 110\ At - < 41 30 /�1�rft / - / 31 . � . u ity Clerk Mark Stodola, ayor Tin i 32 APPR S `i • .
