3 AN ORDINANCE CONDEMNING REAL PROPERTY WITHIN THE CITY OF LITTLE
4 ROCK, ARKANSAS ON BEHALF OF THE LITTLE ROCK ADVERTISING AND
5 PROMOTION COMMISSION FOR THE CONSTRUCTION OF PARKING FACILITIES
6 CRITICAL TO THE OPERATION OF THE STATEHOUSE CONVENTION CENTER;
7 DIRECTING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS;
8 AND FOR OTHER PURPOSES.

10 WHEREAS, the Little Rock Advertising and Promotion Commission (the "Commission") constructed,
11 operates and maintains the Statehouse Convention Center (the "Convention Facilities"); and
12 WHEREAS, the Commission has determined that having adequate parking facilities adjacent to the
13 Convention Facilities is critical to the efficient and production operation of said facilities; and
14 WHEREAS, due to its immediate proximity to the Convention Facilities, the East half of Block 2,
15 Original City of Little Rock, Pulaski County, Arkansas, is an ideal location for the construction of a multi-
16 story parking facility to serve the Convention Facilities;
17 WHEREASj the City has determined that acquisition of the above described property is needed for the
18 public purposed stated herein.
19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
20 ARKANSAS:
21 Section 1. The City of Little Rock does hereby condemn for the public purpose of constructing
22 adequate parking facilities adjacent to the Statehouse Convention Center the following real property lying
23 in the City of Little Rock, County of Pulaski, State of Arkansas, to-wit:
24 The East half of Block 2, Original City of Little Rock, Pulaski County, Arkansas
25 Section 2. The City of Little Rock hereby declares that the above-described land is needed for public
26 purpose as aforesaid and that it desires to acquire fee simple title to said land and the City Attorney is
27 hereby authorized and directed to employ all necessary measures to acquire fees simple title to said land,
28 including the power of eminent domain, to file in the proper court proceedings under the City's power of
29 eminent domain for the condemnation of said land and secure an order of said court permitting the City to
30 take possession of said property and to do any and all other things necessary in order to obtain immediate
31 possession of said property for the use and benefit to the Commission.

1 Section 3. Severability. In the event any title, section, paragraph, item,sentence,clause, phrase,or
2 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
3 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
4 effect as if the portion so declared or adjudged to be invalid or unconstitutional was not originally a part of
5 the ordinance.
6 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
7 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
8 Section 5. The Board of Directors hereby determines that there is a need for additional parking
9 facilities situated conveniently adjacent to the Statehouse Convention Center facilities which are critical to
10 the operations of the Convention facilities in order to serve the citizens of the City of Little Rock,
11 therefore, an emergency is hereby declared to exist, and this ordinance being necessary for the public
12 health, safety and welfare shall be in full force and effect from and after its passage and approval.
