HomeMy WebLinkAbout21523 1 ORDINANCE NO. 21,523 2 3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE TO 4 BID; TO AUTHORIZE THE CITY MANAGER TO EXTEND THE 5 CONTRACT WITH ARKANSAS MUNICIPAL LEAGUE—MUNICIPAL 6 VEHICLE PROGRAM, AT A TOTAL COST OF FOUR HUNDRED FORTY 7 THOUSAND DOLLARS ($440,000.00), TO ADMINISTER A SELF- 8 INSURANCE PROGRAM FOR THE CITY OF LITTLE ROCK'S MOTOR 9 VEHICLE LIABILITY INSURANCE;TO DECLARE AN EMERGENCY;AND 10 FOR OTHER PURPOSES. 11 12 WHEREAS, the City of Little Rock is required by State Law to totally self-insure, or to have some 13 kind of coverage available for motor vehicle accidents as set forth in Ark. Code Ann. § 21-9-303 (West 14 2008); and, 15 WHEREAS, the City participates in an insurance pool through the Arkansas Municipal League- 16 Municipal Vehicle Program to administer a Self-Insurance Program for the City of Little Rock's Motor 17 Vehicle Liability Insurance including Comprehensive and Collision Insurance for current vehicles; and, 18 WHEREAS, the total cost of this purchase is Four Hundred Forty Thousand Dollars ($440,000.00); 19 and, 20 WHEREAS,this extended purchase will provide Motor Vehicle Liability and/or Comprehensive and 21 Collision Insurance for the City's motor vehicles from January 1, 2018,to December 31,2018; and, 22 WHEREAS, additional vehicles will be purchase throughout 2018; therefore, staff may come before 23 the Board with an adjustment in cost; and, 24 WHEREAS,the unique nature of this insurance pool makes it impractical and unfeasible for the City 25 to competitively select a similar carrier; 26 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 27 OF LITTLE ROCK,ARKANSAS: 28 Section 1. The City Manager is authorized to extend the current contract with the Arkansas Municipal 29 League-Municipal Vehicle Program to administer a Self-Insurance Program for the City of Little Rock's 30 Motor Vehicle Liability Insurance including Comprehensive and Collision Insurance for current vehicles, 31 for a total cost for this purchase of Four Hundred Forty Thousand Dollars ($440,000.00). 32 Section 2. Because of the unique nature of the Arkansas Municipal League — Municipal Vehicle 33 Program and the self-insurance pool, the Board of Directors finds that it is impractical and unfeasible to 34 submit this matter for competitive selection. [Page 1 of 2] 1 Section 3. As additional vehicles will be purchased throughout 2018 a future amendment to this 2 resolution or to the amount spent for coverage may be required. 3 Section 4. Funds for this purchase are allocated in Fleet Services 2018 Operating Account No.600020- 4 63610. 5 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 6 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 7 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 8 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 9 ordinance. 10 Section 6. Repealer. All laws,ordinances,resolutions,or parts of the same,that are inconsistent with 11 the provisions of this resolution, are hereby repealed to the extent of such inconsistency. 12 Section 7. Emergency Clause.
