3 A ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ISSUE A
5 PURCHASE ORDER TO AXCON ENTERPRISE, INC., IN AN AMOUNT
6 NOT TO EXCEED ONE HUNDRED TEN THOUSAND, NINE HUNDRED
7 FIFTY-SEVEN AND 91/100 DOLLARS ($110,957.91),FOR PURCHASE OF
8 FORTY-THREE (43) LESS-THAN-LETHAL ELECTRONIC CONTROL
9 TASER DEVISES FOR THE LITTLE ROCK POLICE DEPARMTENT;
10 AND FOR OTHER PURPOSES.

12 WHEREAS, there is a need to purchase forty-three (43) Less-Than-Lethal Electronic Control Taser
13 Devises to be used by the Little Rock Police Department; and
14 WHEREAS,Axon Enterprise,Inc., is the sole supplier of the Taser Devices which meet Departmental
15 specifications and has the ability to record actions during the deployment of the devise; and,
16 NOW,THEREFORE,BE IT ORDAINCED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS:
18 Section 1. The Board of Directors hereby authorizes the City Manager to purchase forty-three (43)
19 Less-Than-Lethal Electronic Control Taser Devises to be used by the Little Rock Police Department.
20 Section 2.Funds for this purchase in the amount of One Hundred Ten Thousand,Nine Hundred Fifty-
21 Seven and 91/100 Dollars ($110,957.91), including taxes, are available from 3/8-Cent Sales Tax Project,
22 Account No.TS52A24.
23 Section 3. Because Axon Enterprises,Inc., is the only authorized distributor of this model in the area,
24 the Board of Directors declare it is impractical and unfeasible to submit this purchase to competitive bids.
25 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
26 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
28 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
29 ordinance.
30 Section 5. Repealer. All laws,ordinances,resolutions, or parts of the same,that are inconsistent with
31 the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
32 Section 6. Emergency Clause.The ability to have an adequate number of Less-Than-Lethal Electronic
33 Control Taser Devises for Little Rock Police Officers is essential to the public health, safety and welfare;

1 an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and
2 after the date of its passage.
