3 A RESOLUTION TO AUTHORIZE THE MAYOR OF THE CITY OF
4 LITTLE ROCK, ARKANSAS, TO ACCEPT FOR MUNICIPAL
5 PURPOSES, PERMANENT CONSTRUCTION EASEMENTS, RIGHT-OF-
6 WAY DEDICATIONS AND FEE SIMPLE ACQUISITIONS, AND THE
7 CITY MANAGER TO ACQUIRE TEMPORARY CONSTRUCTION
8 EASEMENTS AS NEEDED TO COMPLETE THE CONSTRUCTION OF
9 THE 2016 THROUGH 2018 STREET AND DRAINAGE CAPITAL
10 IMPROVEMENT PROGRAM; AND FOR OTHER PURPOSES.

12 WHEREAS, the Public Works Department has initiated a Capital Improvement Program funded by
13 the 3/8-Cent Capital Improvement Sales and Compensating Use Tax for constructing Street and Drainage
14 Improvement Projects throughout the City as authorized by Resolution No. 14,310 (March 15, 2015),
15 and;
16 WHEREAS,the acquisition of easements is needed to accomplish the construction, maintenance and
17 continued access of street and drainage improvements.
18 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
19 OF LITTLE ROCK,ARKANSAS:
20 Section 1. The City Manager is authorized to pursue the acquisition of permanent construction
21 easements, right-of-way dedications, fee simple acquisitions, and temporary construction easements as
22 need to complete the projects identified in Resolution No. 14,310 as amended.
23 Section 2. The Mayor is authorized to accept permanent construction easements, right-of-way
24 dedications and fee simple acquisitions for municipal purposes and the City Manager is authorized to
25 accept temporary easements needed for construction.
26 Section 3. Funding for acquisition of easements and dedications is from the amounts allocated to
27 each Ward for the projects.
28 Section 4. Severability. In the event any title, section, para 'a h item, sentence, clause, phraseor
29 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
30 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
31 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
32 resolution.
33 Section 5. Repealer.All laws, ordinances, resolutions,or parts of the same,that are inconsistent with
34 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
