3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REV. CODE S 7 -27 (1988)
4 TO PERMIT THE EXPANSION OF THE LITTLE ROCK MUNICIPAL AIRPORT
5 COMMISSION TO SEVEN (7) MEMBERS; TO DECLARE AN EMERGENCY; AND
6 FOR OTHER PURPOSES.

8 WHEREAS, the Little Rock Municipal Airport Commission ("the Commission ")was created
9 by Initiated Ordinance No. 8511 (1951), and has exercised control of the Little Rock National
10 Airport since that time, and
11 WHEREAS, Ark. Code Ann. S 14- 359 -120 (West 2004) limited the size of the Commission to
12 five (5) members, and
13 WHEREAS, the Board of Directors sought and obtained legislation during the 85th Session
14 of the Arkansas General Assembly which would permit the expansion of the Commission to
15 seven (7) members, and
16 WHEREAS, Act 674 of 2005 was duly passed with an emergency clause and signed into law
17 on March 9, 2005,
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LIT -
19 TLE ROCK, ARKANSAS:
20 Section 1. Little Rock, Ark., Rev. Code S 2 -27 (1988) is hereby amended to read as fol-
21 lows:
22 The municipal airport commission shall be composed of seven (7) citizens who
23 are qualified electors of the city. At least one (1) of the members shall be ex-
24 perienced in aviation holding some type of pilot aeronautical rating. Members
25 commission shall be appointed by the city manager and confirmed by a three -
26 fourths vote of the board of directors. They shall hold office for a term of five
27 (5) years. Terms shall begin on January 1, and end of December 31 of the fifth
28 year thereafter.
29 Section 2. Upon the effective date of this ordinance, the City Clerk shall commence ad-
30 vertisements for the two new open positions on the Little Rock Airport Commission, provided
31 that one person selected will serve a term of four (4) years, and the second person selected
32 shall serve a term of five (5) years.

1 Section 3. New members of the Little Rock Airport Commission shall be subject to the at-
2 tendance requirements set forth in Little Rock, Ark., Rev. Code 5 2 -262 (1988).
3 Section 4. New members of the Little Rock Airport Commission shall be subject to the
4 term limitations set forth in Little Rock, Ark., Resolution No. 8096 (February 1, 1989).
5 Section 5. Severability. In the event any title, section, paragraph, item, sentence,
6 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitu-
7 tional, such declaration or adjudication shall not affect the remaining portions of the ordi-
8 nance which shall remain in full force and effect as if the portion so declared or adjudged to
9 be invalid or unconstitutional was not originally a part of the ordinance.
10 Section 10. Repealer. All ordinances, agreements, and part of the same, inconsistent
11 or in conflict with the provisions of this ordinance are hereby repealed to the extent of any
12 such inconsistency.
13 Section 11. Emergency Clause. Since the heightened public security requirements im-
14 posed on airports by the federal government as a result of the events of September 11, 2001,
15 and in light of the multiple uses and needs for air transportation services at the Little Rock
16 National Airport, it is important properly to oversee airport operations by a Commission that
17 is fully appointed and staffed is essential to preserve the public health, safety and welfare,
18 particularly in this time of heightened security requirements; therefore, an emergency is de-
19 dared to exist and this ordinance shall be in full force and effect from and after the date of
20 its passage.

Attached is a draft of the ordinance to expand the size of the Little Rock Municipal Airport Com-
mission from five (5) to seven (7) members in accordance with Act 674 of 2005. The ordinance is fairly
straightforward, but I would like to point out a few items.
The recitals note how the Commission came into existence, the passage of the new legislation, and
the Board's decision to expand the Commission to seven members.
Section 1 actually amends the current City Code to permit seven members of the Commission.
Section 2 notes that one of the two new appointees will serve a four (4) year term, and he other
will serve a five (5) year term. This is required by Act 674. It also generally meets the state law desire
for staggered terms on government boards and commissions.
Section 3 assures that new members will be expected to comply with the attendance requirements
the Board has set. Please note that even with these attendance requirements, however, it will still re-
quire a three - fourths (3/4) vote of the Board to remove a Commissioner.
Section 4 assures that the new members will be subject to the two -term limitation that the Board
has set for City boards and commissions.
