Roll Call Quorum was present being five (5) in number. Members Present: Marshall Peters Julie Wiedower Susan Bell Bob Wood Randy Ripley Members Absent: None City Attorney: Debra Weldon Staff Present: Walter Malone Citizens Present: None II. Approval of Minutes February 9, 2009 Commissioner Julie Wiedower made a motion for approval of the minutes as submitted. Commissioner Ripley seconded. The Minutes were approved with 5 ayes, 0 noes, and 0 absent. III. Deferred Certificates of Appropriateness None IV. Certificates of Appropriateness None 2 V. Other Matters: Enforcement Issues Staff Walter Malone stated that there are no items on the enforcement issue list. The commissioners did not add any items to the list. Preservation Plan update: Mr. Malone mentioned the three scheduled meetings of March 17 and 18. Discussion was held on the purpose of all three meetings and time and place of each. Mr. Minyard is to email the time and location as of all of the meetings. Edits to Form Letters to Real Estate Agents and Homeowners: Chairman Marshall Peters asked if everyone had a chance to read over the letters. The discussion focused mainly on the letter to the Real Estate Agent. Edits were suggested in paragraph one to remove the word Congratulations from the homeowner letter. In paragraph three, the wording "an auto body repair shop starting up next door" was deleted in favor of more generic terms since the HDC does not govern land use. In paragraph four, the last sentence was moved to the middle of the paragraph. In paragraph five; there was a major rewording of the first part of the first sentence to make the tone more authoritative, yet still friendly and supportive. Other minor edits were noted. Mr. Malone stated that the drafts of the letters would be forwarded to Brian Minyard for final editing. Work Plan: Mr. Malone wanted to clarify that the markups, the strikeouts and the underlined text, were what the commission meant to say on the satellite dish section – Problem 4. A discussion was held about the edits with the visibility of the dish from the street. There was no discussion on problem 5. On Problem 6, regarding Bylaw issues, there was discussion of the proposed edits by Staff. Debra Weldon asked if this was to be without prejudice. It was decided that without prejudice was the intent. Problem #7 – regulating Paint color. Mr. Malone pointed the committee to what other cities are doing in regards to this, and the Staff’s position on page 19 of the re port. Debra Weldon, of the city attorney’s office added that she did not think the commission had to do it. Chairman Peters commented that he would rather not enforce paint color. Commissioner Bob Wood asked what if a Victorian was painted day -glo orange. Ms. Weldon stated that the Commission would have to document what are appropriate colors for that style of house. Chairman Peters asked to put the issue off until discussion at CAMP in May. Guidance is provided in the Guidelines. Two tiers of approval were brought up by Commissioner Woods. Commissioner Wiedower said that she thought we did have it with the COC’s. Ms. Weldon stated that to paint brick that was never painted does require a COA. Commissioner Ripley brought up the issue of repainting the same color versus changing to another color. It was decided to discuss this item again after CAMP in May.
