HomeMy WebLinkAbout14567 1 RESOLUTION NO. 14,567 2 3 A RESOLUTION TO SET A MORATORIUM ON THE APPROVAL OF 4 ANY CONDITIONAL USE PERMIT FOR A RESIDENTIAL 5 DEVELOPMENT IN THE EXTRATERRITORIAL JURISDICTION THAT 6 INTENDS TO USE A PACKAGE PLANT AS THE WASTE WATER 7 TREATMENT PLANT UNTIL THE EXISTING STUDIES ON SEWER 8 SERVICE TO SUCH AN AREA, AND THE PROVISION OF SERVICE TO 9 SUCH AN AREA IS COMPLETE; AND FOR OTHER PURPOSES. 10 11 WHEREAS, in Little Rock, Ark., Resolution No. 14,516 (March 7, 2017),the Board of Directors for 12 the City of Little Rock, Arkansas,authorized the Little Rock Wastewater Utility and the Little Rock Water 13 Reclamation Commission to initiate study on the provision of sewer services to residents located in the 14 Extraterritorial Jurisdiction (ETJ) of the City which would focus upon the economic feasibility and the 15 municipal advantage of such services; and, 16 WHEREAS, in Little Rock, Ark., Resolution No. 14,517 (March 7, 201 7 the Board of Directors), of 17 the City of Little Rock directed the City Manager to conduct a study of the ETJ to determine the cost to 18 provide additional municipal services to this area; and, 19 WHEREAS,until these studies are completed the Board of Directors does not believe it is appropriate 20 to consider any request for a Conditional Use Permit for residential development in the ETJ that depends 21 upon a package plant as the Waste Water Treatment Plant; 22 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 23 OF LITTLE ROCK,ARKANSAS: 24 Section 1. A moratorium is hereby declared and the City of Little Rock,Arkansas, shall not consider 25 the grant of a Conditional Use Permit for waste water treatment in the ETJ that is not part of the Little Rock 26 Wastewater Utility until the studies called for in Little Rock,Ark.,Resolutions No. 14,516,and No. 14,517 27 (March 7,2017)have been completed and reviewed by the Board of Directors. 28 Section 2. This moratorium shall be in effect under ninety (90) days after the completion of the last 29 study referenced in Section 1 above, but in no event, no later than December 31,2018. 30 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,phrase, or 31 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adju- 32 dication shall not affect the remaining portions of this resolution, which shall remain in full force and ef- 33 fect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the • 34 resolution.
