HomeMy WebLinkAbout21336 1 ORDINANCE NO. 21,336 2 3 AN ORDINANCE TO AMEND CERTAIN SECTIONS OF THE LITTLE 4 ROCK TRANSPORTATION CODE, LITTLE ROCK, ARK., REV. CODE 5 § 34-1 TO § 34-141 (1988); TO DECLARE AN EMERGENCY; AND FOR 6 OTHER PURPOSES. 7 8 WHEREAS, the Board of Directors of the City of Little Rock, Arkansas, has adopted a 9 comprehensive Transportation Code which governs the operation of vehicles for hire within the corporate 10 limits of the City,and 11 WHEREAS,there is now a desired to amend the Transportation Code. 12 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 13 OF LITTLE ROCK,ARKANSAS: 14 Section 1. Little Rock, Ark., Rev. Code § 34-4(1988), Definitions, Taxicab, is hereby amended to 15 read as follows: 16 "Taxicab shall mean motor-driven vehicles clearly marked as such, equipped with a 17 taximeter and having a seating capacity not in excess of eight (8) passengers, including 18 the driver,and used for the transportation of persons for hire. A taxicab shall be seven(7) 19 model years old or newer when initially inspected to be placed into service and shall be 20 removed from service at the end of its 10'" model year. Taxicabs modified to meet the 21 requirements of the Americans with Disabilities Act of 1990 (ADA), as amended may 22 include motor vehicles designed for fifteen (15) passengers or less, including the driver. 23 Such a vehicle so modified shall not have a seating capacity in excess of eight (8) 24 passengers, including the driver. Unless the context otherwise requires, as used in this 25 chapter,the term "taxicab" shall be deemed to include taxicabs, livery vehicles, premium 26 taxicabs, and all other demand-response vehicles not otherwise regulated by this chapter, 27 provided that this definition does not apply to emergency medical health vehicles." 28 Section 2. Little Rock, Ark., Rev. Code § 34-4(1988),Definitions, Taximeter, is hereby amended to 29 read as follows: 30 "Taximeter, meter, or other electronic device shall mean a device which mechanically or 31 electronically computes and registers in dollars and cents for viewing by the passenger 32 the fare based upon mileage distance traveled." !Page 1 of 21 1 Section 3. Severability. In the event any section, subsection, subdivision, paragraph, 2 subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be 3 invalid or unconstitutional, such declaration or adjudication shall not affect the remaining provisions of 4 this ordinance,as if such invalid or unconstitutional provision was not originally a part of this ordinance. 5 Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this 6 ordinance are hereby repealed to the extent of such inconsistency. 7 Section 5. Emergency. Since the City's Transportation Code was intended to be a 8 comprehensive codification of ordinances dealing with for-hire transportation within the City of Little 9 Rock, Arkansas, and such regulation is essential to protect the public health, safety and welfare, an 10 emergency is declared to exist and this ordinance shall be in full force and effect from and after the date 11 of this adoption. 12 PASSED: December 6,2016 13 ATTEST: APPROVED: 14 15 4' !
