3 A RESOLUTION TO AUTHORIZE THE MAYOR, CITY CLERK AND
4 CITY MANAGER TO EXECUTE A TEMPORARY CONSTRUCTION
5 EASEMENT LOCATED AT KANIS PARK TO THE ARKANSAS
6 HIGHWAY AND TRANSPORTATION DEPARTMENT AS A PART OF
7 THE PROJECT TO WIDEN INTERSTATE 630 FROM BAPTIST
8 HEALTH DRIVE TO UNIVERSITY AVENUE; AND FOR OTHER
9 PURPOSES.

11 WHEREAS,the Arkansas Highway and Transportation Department(AHTD) is undertaking a project
12 along Interstate 630 from Baptist Health Drive to University Avenue which will necessitate the
13 acquisition of a Temporary Construction Easement from the City at Kanis Park to reconfigure and
14 reconstruct a portion of a bike trail; and,
15 WHEREAS, AHTD has requested a donation of the easement needed from the City to accomplish
16 this portion of the construction; and,
17 WHEREAS,the City Board of Directors has determined that it is in the best interests of the City and
18 its inhabitants for the City to donate temporary easement to AHTD.
19 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK,ARKANSAS:
21 Section 1. The Mayor, City Clerk, and City Manager are hereby authorized to execute, in a form
22 approved by the City Attorney, any sales contracts and documents required to convey to AHTD a
23 Temporary Easement located in Pulaski County, Arkansas, more particularly described as follows:
24 Tract 1-EI
25 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
26 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the resolution which shall remain in full force
28 and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a
29 part of the resolution.
30 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
31 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
