HomeMy WebLinkAbout21326 1 ORDINANCE NO. 21,326 2 3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF A 4 COMPETITIVE SELECTION PROCESS AND AUTHORIZE THE CITY 5 MANAGER TO ENTER INTO A SOLE-SOURCE PROFESSIONAL 6 SERVICES AGREEMENT WITH NELSON/NYGAARD CONSULTING 7 ASSOCIATES, INC., FOR TECHNICAL AND CONSULTING SERVICES 8 RELATED TO THE 30 CROSSING PROJECT; AND FOR OTHER 9 PURPOSES. 10 11 WHEREAS, City Staff issued a Request for Qualifications ("RFQ") in order to secure the services 12 of a Planning Consultant to undertake a comprehensive review of the 30 Crossing Project("Project")and 13 make recommendations as to actions the City should take in order to maximize the benefits of the Project 14 and minimize any negative aspects of the Project; and, 15 WHEREAS, the most qualified submission for these services was made by Nelson/Nygaard 16 Consulting Associates, Inc. ("Nelson Nygaard"); and, 17 WHEREAS, on February 16, 2016, the City Board of Directors adopted Resolution No. 14,288 to 18 authorize the City Manager to enter into a contract with Nelson/Nygaard to provide consulting services 19 as described above in the amount of Seventy-Five Thousand, Seven Hundred Seventy Dollars 20 ($75,770.00), plus contingencies; and, 21 WHEREAS, on March 2, 2016, the City and Nelson Nygaard entered into a Professional Services 22 Agreement for Nelson Nygaard to provide the City with Planning and Consulting Services to articulate a 23 core set of community-driven goals for Downtown Little Rock relative to the Project and make 24 recommendations to the City accordingly; and, 25 WHEREAS, the Scope of Work in this Professional Services Agreement included items such as an 26 assessment of development plans and draft design documents submitted by the Arkansas Highway and 27 Transportation Department, interview of key stakeholders, a market analysis and the creation of a 28 Downtown Vision that will include an assessment of and recommendations concerning east-west 29 connectivity; and, 30 WHEREAS, the tasks in this Scope of Services were completed and the Agreement subsequently 31 expired on May 31,2016; and, 32 WHEREAS, it has now been determined that the continued technical and consulting assistance on 33 the 30 Crossing Project would be beneficial to the City through the final design phase of the Project; and, [Page 1 of 2] 1 WHEREAS,Nelson/Nygaard has a thorough understanding of the City's issues and concerns related 2 to the Project and has developed a good working relationship with the City; and, 3 WHEREAS, because of Nelson/Nygaard's knowledge of the Project and involvement by 4 representing the City at various meetings, preparing a "White Paper" and a comment letter on the 5 Project's alternatives and concepts, a competitive selection process should be waived and a Professional 6 Services Agreement awarded to Nelson/Nygaard as the sole-source provider on an as-needed basis for 7 continued technical and consulting services regarding the 30 Crossing Project for a time period of one 8 (1)-year. 9 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 10 OF LITTLE ROCK,ARKANSAS: 11 Section 1. The Board of Directors finds that a competitive selection process should be dispensed 12 with relative to continued technical and consulting services concerning the 30 Crossing Project and a 13 Professional Services Agreement for such services should be awarded to Nelson/Nygaard in an amount 14 not to exceed Fifty Thousand Dollars ($50,000.00), as the sole-source provider for these services on an 15 as-needed basis for a time period of one(1)-year. 16 Section 2. Funding for these services is available from Account Number 10833949000S33A714. 17 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 18 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 19 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 20 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 21 ordinance. 22 Section 4. Repealer.
