That the zoning classification of the following described property be changed from 0-3, 13 General Office District,to PD-C, Planned Development-Commercial: 14 Z-9162: Part of the Northwest Quarter Northwest Quarter of Section 10, Township 15 1 North, Range 13 West, Little Rock, Pulaski County, Arkansas, more particularly 16 described as: Commencing at the northwest corner of said Northwest Quarter 17 Northwest Quarter; thence South 88 degrees 08 minutes 06 seconds East along the 18 north line of said Northwest Quarter 454.60 feet to a point on the south right-of-way 19 of Kanis Road and the point of beginning; thence South 83 degrees 13 minutes 59 20 seconds East along said south right-of-way line, 190.80 feet; thence South 01 degrees 21 43 minutes 09 seconds West 253.30 feet; thence North 88 degrees 22 08 minutes 06 seconds West, 193.0 feet; thence North 02 degrees 23 20 minutes 37 seconds East, 269.61 feet to the point of beginning containing 50,086 24 square-feet or 1.1298 acres,more or less,less and except the east twenty-five(25) feet 25 reserved for a road. 26 Section 2. That the preliminary site development plan/plat be approved as recommended by the Little 27 Rock Planning Commission. 28 Section 3. That the change in zoning classification contemplated for Zaxby's Restaurant Short-form 29 PD-C, located at 10601 Kanis Road(Z-9162), is conditioned upon obtaining final plan approval within the 30 time specified by Chapter 36, Article VII, Section 36-454 (e)of the Code of Ordinances. 31 Section 4. That this ordinance shall not take effect and be in full force until the final plan approval. 32 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, 33 Arkansas,and designated district map be and is hereby amended to the extent and in the respects necessary 34 to affect and designate the change provided for in Section 1 hereof. In the event any title, section, paragraph, item, sentence, clause, phrase, or 2 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 3 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 4 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 5 ordinance. 6 Section 7. Repealer.
