ORDINANCE NO. 12,871
ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING
THAT CERTAIN ALLEY IN BLOCK 74 ORIGINAL CITY OF
LITTLE ROCK, ARKANSAS.
WHEREAS, a petition was duly filed wi.th. the Board of Directors
of the City of Little' Rock, Arkansas, on.the 20th day of September,
1973, asking the Board of Directors to vacate and abandon all of
that certain alley in Block- '74, Original City of Little Rock., being
described as the South 10 .feet of Lot 2, Block 74, Original City
of Little Rock, a plat of said Block being recorded in Deed Book
L at page 330 in the Deed Records 'of the Circuit Clerk of Pulaski:
County, Arkansas, subEject, however, to any public utility: easements
located in said alley; and
WHEREAS, after due.:notices: as: required by lair, the Board of
Directors has at the time and place mentioned in the: notice, heard
all persons desiring to be heard on the question and has ascertained
that said alley was used as a passageway by the public generally
so as to acquire a passageway by prescription although the same
was not ever dedicated to the public for such: use as an alley; that
the same is not now used as a public thoroughfare; that all of the
present owners of the property abutting upon the 'alley to be vacated
have filed with the 'Board of Directors a petition for :such;abandon-
merit; and that the public interest and welfare will not be' adversely
affected by the abandonment of such alley;
NOW, THEREFORE,: BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE` .ROCK, ARKANSAS:
SECTION 1. The City of Li.ttle'Rock, Arkansas., hereby releases,
vacates: and abandons all its rights, ,together with .the rights of the
public generally, in and to the alley .designated as follows.:
The South: 10 :feet 'of Lot 2,
Block- 74,, Original City of
Little' Rock, Arkansas.,.
subject, however, to any public utility: easements presently
located in said alley.
SECTION 2. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the office of the :Recorder
of Pulaski County and recorded in the Deed Records of the County.
SECTION 3. This Ordinance shall take effect and be in
force from and after its passage.
