On February Z2,198Z,the Little Rock Board of Adjustment,acting under its authority granted by Chapter 43,Section 3-101C,o1 the Code of Ordinances,interpreted Section 4-102fl of thatsameChapter43.such that a structural addition is not anamendmentorchangetoaconditionaluseauthorizatj.on.
Therefore,the Green Tree Nursery would not be required to seekeitherrezoningoraconditionalusepermitpriortoobtainingabuildingpermitfortheproposedstructuraladditionontoitsexistingbuilding.
This,interpretation is considered to apply to all structuraladditionsonpropertiesuponwhichconditionalusesarelocated.In a secondary action,the Board of Adjustment did instructtheChairmanofthatbodytowritealettertotheChairmanoftheLittleRockPlanningCommissionsuggestingthatan1111endmenttothetextoftheOrdinancebeconsideredwhich wouldclarifythemeaningorintentofthatsectionof-the Ordinance.

Si-:CTION I,That the text of Chapter 43,Section 4-102JJ,
oi the Code of Ordinances of the City of Little Rock,
Arkansas,be amended to read as follows:
J-J.CONDITIONS
Once any portion of the conditional use authorizationisutilized,all such conditions pertaining to suchauthorizationshallbecomeimmediatelyoperative.The violation of any condition so imposed shallconstitutegroundsforrevocationoftheconditionaluseauthorization.Such conditions may include timelimitsforexerciseoftheconditionaluseauthorization;otherwise,any exercise of such authorization mustcoannencewithinareasonabletime.No conditionaluseauthorizedbythePlanningCommissionand,BoardofDirectorsshallbesubsequentlyappliedforavariancetotheBoardofAdjustment.Amendments orcJ»&nues as to the use authorized b the conditionaluseprocessmustfoll.ow the same recess as the ori inalcondit&.onal use a lication.Ex ansions or ad ztronstost&uctures associated with existin and/or revi~ousla»'oved conditional uses ma be a roved withoutfurtherconditionaluseauthorizationunderthe followincrrcumstances:
