"'AN ORDINANCE TO AMEND SECTION 1 OF LITTLE ROCK, ARK.,
4 ORDINANCE NO. 21,279 (AUGUST 16, 2016), TO CORRECT THE
5 PROPERTY DESCRIPTION FOR THE ARKANSAS CHILDREN'S
6 HOSPITAL PEDIATRIC CLINIC SHORT-FORM POD, LOCATED ON
7 THE EAST SIDE OF THE 9000 BLOCK OF DAILEY DRIVE (Z-8764-A),
8 LITTLE ROCK, ARKANSAS; TO DECLARE AN EMERGENCY; AND
9 FOR OTHER PURPOSES.

11 WHEREAS,the Board of Directors passed Little Rock,Ark. Ordinance No.21,279(August 16,2016)
12 to permit a Short-Form POD for Arkansas Children's Hospital Pediatric Clinic; however, the ordinance
13 inadvertently included an erroneous property description; and,
14 WHEREAS, the notices, description in the record before the Planning Commission, and all other
15 matters correctly and clearly identified the property that is the subject of the zoning change, so that the
16 correction of the property description is merely an administrative matter;
17 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK,ARKANSAS:
19 Section 1: Section 1 of the Little Rock, Ark., Ordinance No. 21,279 (August 16, 2016) is hereby
20 amended to read as follows:
21 Section 1. That the zoning classification of the following described property be changed from R-2,
22 Single-Family District, to POD, Planned Office Development:
23 Z-8764-A: City of Little Rock, Arkansas - Dailey Drive - A part of the N1/2 of the
24 NW 1/4 of Section 1, Township 1 South, Range 13 West, Pulaski County, Arkansas,
25 more particularly described as follows: Commencing from the SE corner of the N1/2
26 of the NW 1/4 of Section 1,Township 1 South,Range 13 West;thence North 86 degrees
27 50 minutes 09 seconds West, a distance of 141.43 feet to a set '/2-inch rebar with cap
28 for the point of beginning;thence North 02 degrees 23 minutes 00 seconds East 361.45
29 feet; thence North 87 degrees 08 minutes 24 seconds West 364.80 feet; thence South
30 04 degrees 26 minutes 25 seconds West, 161.04 feet; thence South 87 degrees 39
31 minutes 38 seconds East, 138.95 feet; thence South 03 degrees 18 minutes 06 seconds
32 West,200.48 feet; thence South 86 degrees 50 minutes 09 seconds East,234.85 feet to
33 the point of beginning.

1 Section 2. Severahi/ih•. In the event any title, subtitle, section, subsection, subdivision, paragraphs,
2 subparagraph,item,sentence,clause,phrase,or work of this ordinance is declared or adjudged to be invalid
3 or unconstitutional,such declaration or adjudication shall not affect the remaining portions of the ordinance
4 which shall remain in full force and effect as if the portion so declared or adjudged invalid or
5 unconstitutional was not originally a part of this ordinance.
6 Section 3. Repealer. All ordinances, resolutions, or parts of the same that are inconsistent with the
7 provisions of this ordinance are hereby repealed to the extent of such inconsistency including, but not
8 limited to Little Rock, Ark.,Ordinance No. 21,279(August 16,2016).
9 Section 4.Emergency Clause. The ability to accurately note changes in the zoning map for the City of
10 Little Rock, Arkansas, and to permit approved projects to move forward with construction is essential to
11 the public health, safety, and welfare, particularly where, as here, parties have materially changed their
12 positions in reliance upon approved changes to the zoning map; therefore, an emergency, is declared to
13 exist and this ordinance shall be in full force and effect from and after the date of its ••ssage.
