This developer proposes to construct 262,dwelling units in a total
of 11 buildings,two of which will be occupied by the office
leasing area and a clubhouse.The site also includes tennis
courts,swimming paal aud other fitness and recreati.anal activity
areas.The yxaject,as offered consists of a series of buildings,
most af which axe three staries in height.The eastern one-half af
the yxoject is pxoposed t:o be constructed at a somewhat higher
level of elevation than the western one-half.The xeason for this

The Planning staff has worked with this develoyex in an
attempt to present to the Commission a thoroughly thought outxesidential.planned unit development submittal.At this
writing,the staff is x'eviewing this proposal from a sketchy
plan without benefit of elevations,sections or othex'etailstovisuallFandphysicallytiethisprojecttothedevelopment
on the south.
Thexe are guite a number of axeas of information that we
recyxire yriox to developing a xecommendati.on on this case.ItisouxopinionthatMr.Carl needs to do additional work onthisproject.Its magnitude reguires significant input of
time,energy and design.The ylan presented to us,at,this
time,does not fulfill the xeview reguirements of a planned
unit development.

recommendation.Richard Woad of staff reyoxted that the complete
and detailed plans of this project were x'eceived too late im ordertoproperlyrevxewandprocesstheinformation.Staff has
discussed the ayylicati.on and a deferral with Mr.Carl.He has
indicated that he will accept the deferral ta Decemlber 15 in ordex"
to pxcperly receive review and.staff input.
The Chairman then asked Mr.Caxl if he had comments.Mr.Carl
stated that staff had reported the item as he undexstood the issue,
He accepted the defexral.A motion was made to defex'he item to

offexed a lengthy list consistimg of some 16 axeas of imterest orconcernonthepartofthestaff.These items dealt with designdetailfortherewisedsiteylam.These 16 areas wexe discussed at
length with little or no resolution to the several principal
concexns.Those concerns being a pravisi.on far a lowex density onthissitethanthe37unitsyexacrewhichisapparent.fram the

After a brief discussion,the Cammiesian determined to place this

Sidewalks have been a requirement in the Littl.e Rock jurisdictionsince1958forpurposesafSubdivisionRegulatians.
Building codes and houndIary street ordinances have rerxuired themforalongerperiodI.
They have been reguired sporadically awex time with the Planning
Commissian.waiving sidewalks consistently during the 1960's and1.970's.The pximary basis fax waiver being the absence ofexistingsidewalknetwoxks.
Since 1979 the Subdivision Regulatians have been applied in aevenmannex'nd consistent.This timeframe is tiedI to tbe
adiaption af the curxent Bubdiwi.sion Regulations and themodernizationafstandards.
Since late 1990 tIhe Planning Commission has not dealt withwaiv'ers or wax'iance.The Baard af Dixectox's now xeviews allrecZuests.
ln recent months an unwritten policy has developed which hasencourageddeferralforafixedtimeinsteadoftotalwaiver.
The only area of the jurisdiction where waivexs axe granted istheextxemeouterareaaftheextx'aterritorial subdivisionauthorityinwhichareathexearefewurbanstandardsof curbguttexaxsidewalk.

Richard Wood of the Planning staff offered,a brief historY ofthisordinanceproposal.indicating that it originated with the

be needed due to the significant number of waiver requests
received within the industrial axeas.wood pointed out tihat the
Board of Directors had approved almost al.l of the requests that
have been pxesented,with a numbex of them receiving some type of
deferral or conditional waivex.Woad statedi that the Board was
concerned that.they wexe cantinuallY xeviewing these kinds of
varianees in cixcumstances whex'e the city ordinance did not
provide far methods of dealing with sidewalks where theY are
trulY not needed.
Waod stated that the Board asked that staff prepare a ordinance
with the directions that You have in this package.Wood paintedl
aut that the administrative direction of this ordinance is toward
the Boundaxy street Oxdinauce whielh is utilized in most all
instances for sidewal.k requirements„except where there is a new
plat involved.Be continued by saying that Chapter 30 is tiedl in
this axdinance to the Bubdivisian Regulatians Chapter 31 which
establishes the three yx'oyosed,exclusion zones,wood made
refexence to the three graphics that are in the package,
indicating three areas chosen.Woad poin'ted out.tibet the onlY
exception in these exclusion zones is the instance where a new
development occurs with a new street,with complete improvements
required and ties inta an existing sys'terna whex'e thex'e ax'e
sidewalks,
Wood.stated the effect af this ordinance is ta eliminate that
circumstance whexe we initiate construction of a small piece of
sidiewalk in the middle of an area that is built up which would go
mo where.Wood reported that in support of tibia ordinance
construction he performed a fieldl suxvey of all of the streets
within the three areas involved,with the result being that less
than 1/4 mile of sidewalk exists in all three areas.The xeasonforthisbeingexplainedastwooftheareasbeingdeveloped
before city regulation,and one axes being the little Rock Bort
being developed in a very large lat unique cixcumstance.That.
cixcumstance being streets of a diffexent design nature whexeby
sidewalks do not.work very wel.l.woad concluded his x'emax'ks and
offered the pxaposed oxdinanee to the Commission fax their
discussion.
The Chairman„Mr.Walker,then asked if there was discussion from
the Commission.Commissioner Nicholson offered that she had an
observation wihich she would like to make.She stated it
concerned a discussion with staff about a paragraph an page 3 of
the staff write-uy.This paragraph in the last sentence states
that sidewalks as a service ta schools have been reduced by
busing.Commissionex'ieholsan stated that she takes exceptiantathatcomment.Bhe sta'ted that she felt although there is
significantly more busing,chil.dxen have to walk get to the bus
stops She stated.that she felt it reallY dependent on what
neighborhood You were talking about as to whether or not there
was a reduction.

She added an a~tended comment concerning a recent year's conflict
between the City of Little Rock government and the Little Rock
School Board relative to school busing.The conflict having to
do with the reguirement of parents for theix'hildren being
picked up x'ether than walk along congested dIangerous routes.
Commissioner Nichclson stated this concern had to do with the
children living outside the one mile service radius of the schoolinozdextogualifyforthebusing.She stated that she feltthisobservationneeded,some debate,but that it dM not,specifically attach to industrial sMewalk issue.
Wood saM the comment in the wxite-up was only his observation.
He furthex'ent on to explain that his intention by that commentdealtwithallofthechildrenwalkingtoschoolversusthe
smaller amount which cuxxently utilize sidewalks in oxdex to walktosclhool,Commissicnex'icholson then introduced a comment
concerning the fact that Little Rock does have a number of
neighborhood schools.Although they are px'incipally in the coreareaofthecity,she felt like the p3.arming staff and Commission
should be careful in making sucih observations.
Richard wood pointedI out.that he had no real concexns about,that
sentence one way or the other,and if the Commission so desired,it could be removedi.Commissionex'icholson then stated that she
would feel a higher comfoxt level with this ordinance and the
suppoxting material if the item was xemoved.WIood pointed outthatlhedMnotfeelthatthisstatementcommittedIthaBoardor
the planning commission to anything.Xt was simply a staffobserv'ation.
Commissionex Putnam then asked a guestion as to what we were
taking out.Richard Wood explained the conv'ex'sation with
Commissionex'icholson xelative to the sidewalk and school busingissue.Commissionex Nicholson pointed out that the only reason
she raised this is that she felt seeds are sometimes pl.anted
which slhould,nct be planted,and she had been on the Commission.

problem with the oxdinance.She stated that,hex pxoblem was with
generalized statements such as the one pxesented by staff.
Chairman Walkex pointed out that the minute recoxd couldcertainlyreflectCommissionerNicholson's concerns and objectiontothematerialpresented.

offered relative to sidewalk/jogging trails.He fe3.t this

would perhaps even make it easier to hold the line i.n reguiring
sidewalks in area that axe nat included.The Chairman them
recognized Ruth Bell,reyxesentative of the League af Women
Voters.Ms.Bell deferred ta Commissioner Olesan.
Cammissionex Oleson stated she had one guestian.She asked,if
this is a braad statement just involving industrial areas,snd to
specifically the three areas painted out by staff in its
graphics.Richard Wood of the staff directed the Commissiam to
the ordinance in thai.r package af materials.He gaimited ta the
legal description in each of three areas,specifically defiming
the boundary of the three industrial exclusion zones.
Commissioner Gleson asked if this is a well-defined axes.Woad
responded by saying yes,it is a well-defined area and the
boundIaries follows centerlines of streets and such around the
geximetex of the thxee areas.Several guestiams were then posed
as to whether not the boundary in the ares of East 15th Street
imcluded or excluded the ~euser-Busch facility.General
discussion between severa3.membexs of the Commission and staff
indicated that ithe boundary gex'hays did not include that
business.

comment was made to the effect that thexe was only one
xesidentia3.property i.nc3uded within the lbaundary of these three
zones.The reason staff did not specifically delete by baundary
the axes on Security and Royce wss we would Ihave an exclusion

confusion.Wood poi.nted out that the residential sx'es curxemtlyisreceivingpublicfundsforstreetimpxovememtsandsidewal.ks.
In fact,it is the only sidewalk in this gart af the city.
Ruth Bell them came to the lectern amd offered her concerns which
she stated were generally the same as Commissianex Oleson.She
said that she felt like perhaps we would.have to write aff these
areas of the city fax sidewalks for a number af xeasoms beyond
our control.Her real concern was that perhaps something
somewhere im tlhis ordinance would lead ta a feeling whexe i.t is
akay not to have sidewalks around schools or it is okay'o not
ever have sidewalks in sn industrial axes.Specifically,she was
asked if there was anything in this axdinance to prevent thaty

imply that other industrial areas would also x'ecei.ve such
waivers?Richard Wood responded by saying no,the ordinance isspecificallydesignedforthesethreeareas.There is nc
language to leave that implication.Wood made a comment to theeffectthatthereareareasofthecitywhichcouldbeplacedin
exclusion zones with 1i.ttle or no effect.Since they're alreadybuiltup,there would be building permits or futuze development;therefore,no sMewalks are reguired.Chairman Walker then
pointed out that these exemptions indicate that it is practicaltcexcludesidewalksinsomelocationsinthecityandmaybe
used as ar~nt to support a waivex reguest in othez axeas of
the city.Xn fact,the Commission could not deny 'this potential.
He stated that he felt the Commission's effort hex'e should be to
remove the waiver reguest reguirement in all areas of the city
where i't is consistent to do so
To reguire an applicant to come in and ask for a waiver on no
rezoning or commission action which was consistent in the pox't
fox the sMewalk,we may have them building sMewalk to avoM
coming thx'ough the Planning Commission.It is inappropriate for
sidewalk to nowhere„so maybe this is a way for expediting the
pxocessing of people through the system.He stated tibet he feltitwillnotfoxeclosetheOtterCreekIndustrialparkfxom
pxcviding sidewalk when they have any growth in tibet area.
Nr.walker felt that mi.ght indeed be an argument that evezy
industrial areas might make.They are not i.ncluded,within this
exception,but issues of this nature would be up to tlhe
Commission and the City Board.
IWs.Bell stated then that she did not share this concexn byhexself.Chairman Walker then saM he felt that there was
nothing in the ordinance which would caxry ovex to another area.
Ms.Bell stated that all of this convex'sation should be xeflectediintheminutesofthemeeting.Staff stated that the minute

WHEREAS,the Board,of Directors of the City of Little
Rock,Arkansas have determined that certain areas cf thecitycontainuniquecircumstancesrelativetopedestrian
movement,and;
WHEREAS,the Board of Directors have determined a
need to modify standards for placement of sidewalks fox both
new construction and remodeling,and;
WHEREAS,a hardship may be imposed on certain land
owners and occupants by the requirement of sidewalk
construction.

SECTIGN 1.That Chapter 30 and 31 of the Cede of
Ordinances of the City of Little Rock,Arkansas be amendedfox'urposes of providing for modification of the sidewalk
requirements in,certain specified geogxaphic areas as
follows:
Subsection (a).That.Chapter 30„Section 30-281
be amended to provide for insertion of new larguage to
be paragraph (c)and to read as follows:
(c)Fox"purposes of requiring sidewalk

Chairman Walker then,opened discussion on the selection of
members for service on the various commissian committees.
Commissioner walker noted that he had had eanwexsatians with a
number of the commission members.He stated that he had filled
the slots.He has talked with the various members.Chairman
Walker pointed out that he had asked Mr.Ramsey Ball to be
Chairman af the SuMivisian Cammittee and the fallowing sewexal
ayyointments.They axe Diane Chachere,Jerilyn Hicholson,Dim
vanTungeln„~ett Willis will serve on the Plans Committee,
Kathleen Glesan,Bill Putnam and 8ae Se).z will serve on the
SuMiwision Committee.Ran Woods ta stay an the Subdivision
Committee.
Chairman Walks~then asked that those membexs appointed to the
Plans Committee meet and determine among themselves which af
their members they would chose to be theix chairperson.Chai~n
Walker asked that the Plans Committee determined what its plans
wou.ld be far the yeax,and perhaps meet with ROn Hewman of thestaff'a wark out a program since there will not be an ordinance
amendment,package this year as in the past.
Commissioner Wi3.1is then pased,a guestion about his sexwice on
the plans Committee and whethex ox not he could serve on
Subdivision Committee.Chaixman Walkex pointed out that there
axe alxeady five yersons committed to tlhe SuMivision Committee.
Five is the maximum number,but he is surely welcome to sit in on
those accasions when he desires to da so.
Richard Wood pointed out at committee meetings that there really
should nat be maze than five thexe.Woad explained.by saying
because it constitutes a guorum af the commission and makes it afullpublichearing.Chairman Walkex pointed out that
commissioners shauld not be concerned about absence at committee
meetings as they da not count against attendance fox xegular
scheduled meetings.He felt like the Plans Committee could meet
frequently enaugh to deal with the issues they needed ta xewiew.
Howewer,at the same time make it a pleasuxe to serve with that
gramp.
Chairman Walker then raised a new issue fox discussion,being the

this matter is ane af t:he Commission having directed staff to
look at language.Richard Wood stated that he had turned this
issue tc anothex'taff ~r fax'ylaw xeview and development,
and,the matter would be presented to the Commxssxon at a coming
meet;ing
Thexe being no specific resolutian of tlhat issue,tlhe Chaixman
then mavsd to open a discussion fox Ms.Ruth Bell.Ms.Bell
stated that she had.a comment to offer relative to the Annual
Ordinance Amendment package which has been defexxed fax 1993.

elimination of the 1993 Ordinance Amendment.Package,she received
some assurance that:a subject she xaised would be dealt wit:h.

the xecord deals with cuxb cuts on nonxesidential yxoyextiss.Staff will work with the League of Women voters and accept their
dixection initially fox discussion purposes ibefox'e the Plans
Committee.
Staff responded to Ms.Bell's guestion as ta a time line far
introducing an axdinance amendmsnt.Wood's response was to 1st
him camylete other assignments and he would get with ths Xeague
and initiate the issue as soon as possible.
