HomeMy WebLinkAbout21299 ,se„. 1,c CI R c(f�r�, • 111111111111111111111111111111111 2016056063 4 .+. •,� �� PRESENTED:09-07-2016 02:00:10 PM RECORDED:09-07-2016 02.11:11 PM Q y°j a - In Official Records of Larry Crane Circuit/County Clerk 4.LU'lj i;4347 -4 1 ORDINANCE NO. 21,299PULASKI CO,AR FEE$25.00 iG1tr -11 2 -`Ks �'k!y yP �/SOU lY, 3 AN1,ORDINANCE TO AMEND LITTLE ROCK, ARK., ORDINANCE NO. 4 19,246 (DECEMBER 7, 2004) TO ADD THE SEPTEMBER 2015 CAPITAL 5 IMPROVEMENTS PLAN AS ADDITIONAL PROJECTS TO BE INCLUDED 6 IN THE ORIGINAL PROJECT PLAN DATED DECEMBER 7, 2004, 7 INCLUDING THE RIGHT TO IMPROVE ANY AND ALL ROADS 8 LOCATED WITHIN THE PORT OF LITTLE ROCK REDEVELOPMENT 9 DISTRICT NO. 2; TO DECLARE AN EMERGENCY; AND FOR OTHER 10 PURPOSES. 11 12 WHEREAS, the Board of Directors of the City of Little Rock approved the Project Plan dated 13 December 7, 2004, of the Port of Little Rock Redevelopment District No. 2 as specified in Section 5 of 14 Little Rock,Ark., Ordinance No. 19,246,and 15 WHEREAS, the project plan needs to be amended to include those projects described in the 16 September 2015 Capital Improvements Plan of the Port of Little Rock Redevelopment District No. 2 of 17 the City of Little Rock, Arkansas, including improving any and all roads that are located within the 18 Redevelopment District in addition to those projects listed in the original project plan dated December 7, 19 2004; and 20 WHEREAS, notice of a public hearing on the approval to the amendment to the Project Plan, to be 21 held before the Board of Directors on September 6, 2016, at 6:00 PM. at Little Rock City Hall, 500 West 22 Markham Street,Little Rock,Arkansas, 72201, was sent by first-class mail to the Chief Executive Officer 23 of all local governmental and taxing entities having the power to levy taxes on property located within the 24 Port of Little Rock Redevelopment District No. 2 of the City of Little Rock and to the school board of any 25 school district which includes property located within the redevelopment district, specifically, the 26 Superintendent of Schools of the Little Rock School District of Pulaski County, the School Board of the 27 Little Rock School District of Pulaski County, the Mayor of the City of Little Rock, the Pulaski County 28 Judge, and the Pulaski County Treasurer, on July 21, 2016, and was published four (4) consecutive 29 Mondays, starting on August 1, August 8, August 15, and August 22, 2016, in the Arkansas Democrat- 30 Gazette,a newspaper of general circulation in the City of Little Rock; and 31 WHEREAS, representatives of the Little Rock Port Authority have met with representatives of the 32 Little Rock School District of Pulaski County,and the Central Arkansas Library System; and 33 WHEREAS, the amendment to the proposed Project Plan has been presented to the Board of 34 Directors and is on file with the City Clerk, which amended the Project Plan dated December 7, 2004, to [Page 1 of 3] 1 include those projects listed in the September 2015 Capital Improvements Plan of the Port of Little Rock 2 Redevelopment District No. 2, consisting generally of public infrastructure projects including 3 reconstruction of streets within the redevelopment district to bring them to interstate-weight capable 4 standards, installation of water and sewer lines to areas within the redevelopment district that are not 5 currently served, construction of dockside improvements including cranes and warehouses, construction 6 of additional railroad facilities,and site preparation; and 7 WHEREAS,the public hearing has been held on this date at the time and in the place advertised, and 8 interested parties have been afforded a reasonable opportunity to express their views on the amended 9 project plan;and 10 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF LITTLE 11 ROCK,ARKANSAS: 12 Section 1. That the Port of Little Rock Redevelopment District No. 2 of the City of Little Rock, 13 Arkansas Project Plan dated December 7, 2004, as described in Little Rock, Ark., Ordinance No. 19,824, 14 has been amended to include those projects described in the September 2015 Capital Improvements Plan 15 of the Port of Little Rock Redevelopment District No. 2 of the City of Little Rock, Arkansas, and for the 16 right to improve any and all roads that are located within the Port of Little Rock Redevelopment District 17 No.2. 18 Section 2. That the Project Plan dated December 7, 2004, has been amended as of the date of 19 adoption of this ordinance. 20 Section 3. That the Board of Directors hereby finds and determines that the amended project plan 21 will benefit the property within the redevelopment district by discouraging the loss of commerce, 22 industry, or employment and by increasing employment. 23 Section 4. The Board of Directors hereby finds and determines that the amended project plan 24 includes the information required by Ark. Code. Ann § 14-168-306 (b) and hereby approves the amended 25 project plan in the form presented to the Board of Directors at this meeting. 26 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 27 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 28 adjudication shall not affect the remaining portions of this ordinance, which shall remain in full force and 29 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this 30 ordinance. 31 Section 6. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this 32 ordinance, particularly including but not limited to Little Rock, Ark., Ordinance No. 19,246, are hereby 33 repealed to the extent of such inconsistency. 34 Section 4. Emergency.
