3 AN ORDINANCE TO DISPENSE WITH COMPETITIVE BIDS DUE TO
4 AN EXCEPTIONAL SITUATION; TO AUTHORIZE THE CITY
5 MANAGER TO ENTER INTO A SOLE-SOURCE CONTRACT WITH
6 IONWAVE TECHNOLOGIES, INC., IN THE AMOUNT OF TWENTY-
7 FIVE THOUSAND DOLLARS ($25,000.00), INCLUDING APPLICABLE
8 TAXES, FOR THE RENEWAL OF THE CITY'S CURRENT BIDDING
9 SOFTWARE LICENSE AGREEMENT FOR A ONE (1) YEAR PERIOD;
10 AND FOR OTHER PURPOSES.

12 WHEREAS,the City of Little Rock utilizes lonWave Technologies software as its primary application
13 for supplier registration,online bidding,and contract management for the Finance Department's Purchasing
14 Division; and,
15 WHEREAS, the current software license agreement with lonWave Technologies, in the amount of
16 Twenty-Three Thousand, Five Hundred Dollars($23,500.00),expires in September 2016; and,
17 WHEREAS, the cost of Online-Bidding Software Licensing and support would otherwise require a
18 competitive bidding process; and,
19 WHEREAS, because Finance Staff wishes to complete its current transition to online bidding, and
20 because utilization of a different Online-Bidding Software Program would disrupt that transition,the Little
21 Rock Board of Directors finds that it is impractical and unfeasible to enter into a new bid process for Online-
22 Bidding Software;
23 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
24 OF LITTLE ROCK,ARKANSAS:
25 Section 1. The Board of Directors finds that the requirement for competitive bidding for the Twenty-
26 Three Thousand, Five Hundred Dollar ($23,500.00) expenditure is impractical and unfeasible and,
27 therefore, waives the requirement for competitive bidding.
28 Section 2. The City Manager is hereby authorized to enter into an agreement with IonWave
29 Technologies, Inc., for renewal of the City's current software licensing and support agreement for supplier
30 registration, online-bidding and contract management, in an amount not to exceed Twenty-Five Thousand
31 Dollars($25,000.00) including applicable taxes.
32 Section 3. Funds for this expenditure are available in Account No. 102550-61350.

1 Section 4. Severability. In the event any portion of this ordinance is declared or adjudged to be invalid
2 or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this
3 ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or
4 unconstitutional were not originally a part of this ordinance.
5 Section 5. Repealer. All ordinances, resolutions, or parts of the same, that are inconsistent with any
6 provision of this ordinance, are hereby repealed to the extent of such inconsistency.
