3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO
4 EXECUTE AN AGREEMENT WITH THE LITTLE ROCK
5 WASTEWATER UTILITY, IN AN AMOUNT NOT TO EXCEED ONE
6 HUNDRED TWO THOUSAND, THIRTY AND 84/100 DOLLARS
7 ($102,030.84), FOR REHABILITATION OF THE CITY-OWNED JIM
8 DAILEY FITNESS & AQUATIC CENTER SEWERAGE OUTFALL; AND
9 FOR OTHER PURPOSES

11, WHEREAS, the City-owned sewer outfall from the Jim Dailey Fitness & Aquatic Center is old
12 and has partially collapsed and is in need of replacement or full rehabilitation.
13 WHEREAS, the Little Rock Wastewater Utility has offered to perform this work with their
14 rehabilitation contractor provided the city reimburse their actual cost for the work.
15 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
16 OF LITTLE ROCK,ARKANSAS:
17 Section 1. The City Manager is hereby authorized to execute an agreement with the Little Rock
18 Wastewater Utility for rehabilitation of the City-owned Jim Dailey Fitness & Aquatic Center sewerage
19 outfall.
20 Section 2. Funding for this project is from the 3/8-Cent Capital Improvement Sales and
21 Compensating Use Tax, War Memorial and Park Capital Upgrade funds in an amount not to exceed One
22 Hundred Two Thousand, Thirty and 84/100 Dollars ($102,030.84), which is the current contracted unit
23 price amount of Eighty-Five Thousand, Twenty-Five and 70/100 Dollars ($85,025.70), plus 20%
24 contingencies.
25 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
26 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
28 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
29 resolution.
30 Section 4. Repealer. All laws, ordinances,resolutions, or parts of the same,that are inconsistent with
31 the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
32 Section 5. This resolution will be in full force and effect from and after the date of its adoption.
