HomeMy WebLinkAbout14335 1 RESOLUTION NO. 14,335 2 3 A RESOLUTION TO AUTHORIZE THE EXECUTION OF A FIVE (5)- 4 YEAR EXTENSION OF THE INTERLOCAL AGREEMENT BETWEEN 5 THE CITY OF LITTLE ROCK, AKANSAS, AND THE CITY OF 6 SHERWOOD, ARKANSAS, TO ALLOW METROPOLITAN 7 EMERGENCY MEDICAL SERVICES ("MEMS") TO CONTINUE TO 8 PROVIDE EMERGENCY MEDICAL SERVICES AND NON- 9 EMERGENCY ROUTINE TRANSPORTS IN THE CITY OF 10 SHERWOOD, ARKANSAS, PURSUANT TO AN EXCLUSIVE 11 FRANCHISE; AND FOR OTHER PURPOSES. 12 13 WHEREAS on December 6, 2006, the City of Little Rock, Arkansas, and the City of Sherwood, 14 Arkansas, have, by their respective Mayors, previously executed an Interlocal Agreement awarding an 15 exclusive franchise to Metropolitan Emergency Medical Services to provide Emergency Service and Non- 16 Emergency Routine Transport Ambulance Service to the citizens of the City of Sherwood,Arkansas; and, 17 WHEREAS, this Interlocal Agreement has furthered the governmental objective of both entities to 18 provide high quality Advanced Life Support (ALS) and routine transport ambulance service to citizens; 19 and, 20 WHEREAS, the current five (5)-year Interlocal Agreement expired on December 6, 2015, and the 21 City of Little Rock, Arkansas, and the City of Sherwood, Arkansas, desire to extend such Interlocal 22 Agreement for an exclusive franchise for a period of five(5)years to December 6,2020; 23 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 24 OF LITTLE ROCK,ARKANSAS: 25 Section 1. The Board hereby authorizes the Mayor to enter into a five (5)-year extension of the 26 Interlocal Agreement with the City of Sherwood, Arkansas, to December 6, 2020, granting MEMS an 27 exclusive franchise to provide Ambulance Services (emergency and non-emergency) to the City of 28 Sherwood,Arkansas. 29 Section 2. For purposes of this resolution, the term "Ambulance Services" shall include the 30 transportation and care provided the critically ill or injured prior to arrival at a medical facility and within 31 a medical facility subject to the individual approval of the medical staff and governing board of that 32 facility, and further the transport to or from medical facilities including but not limited to hospitals, 33 nursing homes, physician's offices, and other health care facilities, of persons who are infirm or injured [Page 1 of 2] 1 and who are transported in a reclining position or who are ill but considered to be non-emergency in 2 status and who request ambulance transportation. 3 Section 3. Severability. In the event any portion of this resolution is declared or adjudged to be 4 invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this 5 resolution, which shall remain in full force and effect as if the portion so declared or adjudged invalid or 6 unconstitutional was not originally a part of this resolution. 7 Section 4. Repealer.
