HuLASKI CO,AR FEE$20.00 3 AN ORDINANCE TO ABANDON PATRICK COUNTY ROAD AS A 4 PUBLIC RIGHT-OF-WAY LOCATED NORTH OF CANTRELL ROAD, 5 IN THE CITY OF LITTLE ROCK, ARKANSAS (G-23-462); AND FOR 6 OTHER PURPOSES. 7 8 WHEREAS, a petition has been presented for the abandonment of Patrick County Road as a public 9 right-of-way extending north from Cantrell Road to the "Bridge" and the area north of the bridge was 10 previously abandoned; and, 11 WHEREAS; the abandonment request is a fifty (50)-foot wide right-of-way extending from Cantrell 12 Road north approximately 1,050 linear-feet and is located West of Tract E,The Ranch Subdivision, in the 13 City of Little Rock,Pulaski County,Arkansas; and, 14 WHEREAS, none of the public utility companies object to the abandonment request, however, 15 several of the utilities request to retain all or part of the area of abandonment as a drainage and utility 16 easement; 17 WHEREAS, abandonment of this right-of-way will have no adverse impact on the public welfare 18 and safety; and, 19 WHEREAS, the Little Rock Fire Department has reviewed and approved the abandonment request 20 and, 21 WHEREAS,there are no Master Street Plan issues associated with this abandonment request, as the 22 right-of-way is not classified as collector street or higher; and, 23 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 24 OF LITTLE ROCK,ARKANSAS: • 25 Section 1. The Board of Directors hereby releases,vacates, and abandons the Patrick County Road as 26 a public right-of-way extending north from Cantrell Road to the"bridge". 27 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate 28 records of the recorder of the Circuit Clerk in Ex-Officio Recorder of Pulaski County, Arkansas. 29 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 30 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 31 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 32 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part 33 of the ordinance.
