3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO.
4 14,168 (AUGUST 4, 2015) TO SUBSTITUTE NAPA AUTO PARTS FOR
5 SUMMIT TRUCK GROUP TO HAVE THE ANNUAL PURCHASE
6 CONTRACT FOR MOTOR VEHICLE BATTERIES; AND FOR OTHER
7 PURPOSES.

9 WHEREAS, after a competitive bid the Annual Purchasing Contract for batteries for use in all City of
10 Little Rock Fleet Units was awarded to Summit Truck Group in Little Rock, Ark., Resolution No. 14,168
11 (August 4, 2015); and,
12 WHEREAS, Summit Truck Group has since notified the City that it cannot provide the required parts
13 pursuant to the City's bid documents; and,
14 WHEREAS,the City has determined that Napa Auto Parts submitted the next lowest bid and is willing
15 and able to perform the terms of this agreement;
16 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS:
18 Section 1. Section 1 of Little Rock,Ark.,Resolution No. 14,168(August 4,2015)is hereby amended
19 to read as follows:
20 The Board of Directors hereby authorizes the City Manager to enter into an Annual
21 Purchase Contract with Napa Auto Parts for the purchase of batteries for use in all City of
22 Little Rock Fleet Units, in an amount of Sixty Thousand Dollars($60,000.00)per year.
23 Section 2.Repealer. All laws, ordinances,resolutions,or parts of the same,that are inconsistent with
24 the provisions of this resolution, are hereby repealed to the extent of such inconsistency specifically
25 including,but not limited to, Section 1 of Little Rock,Ark.,Resolution No. 14,168 (August 4, 2015).
26 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
27 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
28 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
29 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
30 resolution.
