HomeMy WebLinkAbout14291 1 RESOLUTION NO. 14,291 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ACCEPT 4 BY DEED THE TITLE TO A PARCEL OF LAND LOCATED NORTH OF 5 TANYA DRIVE AND WEST OF JOHN BARROW ROAD IN THE CITY 6 OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS NEEDED TO 7 CONSTRUCT THE TANYA DRIVE AT BARROW ROAD TRAFFIC 8 SIGNAL; AND FOR OTHER PURPOSES 9 10 WHEREAS, the Little Rock Board of Directors authorized the Barrow Road Streetscape Project, 11 Project No. B-6b that includes the relocation of Tanya Drive to align with Patriot Drive to the east, in 12 Resolution No. 13,699 as amended by Resolution No. 14,269; and, 13 WHEREAS,the acquisition of property is necessary for the construction of the project. 14 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 15 OF LITTLE ROCK,ARKANSAS: 16 Section 1. The City Manager is hereby authorized to acquire through a deed and to accept title to the 17 following parcel of land: 18 PART OF THE SOUTH HALF, SOUTH HALF, NORTHWEST QUARTER, 19 SOUTHWEST QUARTER, SECTION 11, TOWNSHIP 1 NORTH, RANGE 13 20 WEST, NOW IN THE CITY OF LITTLE ROCK, PULASKI COUNTY, 21 ARKANSAS, DESCRIBED AS FOLLOWS: BEGIN THIRTY (30) FEET WEST 22 AND 190 FEET NORTH OF THE SOUTHEAST CORNER OF SAID SOUTH 23 HALF, SOUTH HALF, NORTHWEST QUARTER, SOUTHWEST QUARTER; 24 THENCE NORTH 89 DEGREES 45 MINUTES WEST 201 FEET PARALLEL TO 25 THE SOUTH LINE OF SAID SOUTH HALF, SOUTH HALF, NORTHWEST 26 QUARTER, SOUTHWEST QUARTER ; THENCE NORTH 140 FEET; THENCE 27 SOUTH 89 DEGREES 45 MINUTES EAST 201 FEET: THENCE SOUTH 140 28 FEET TO THE PONT OF BEGINNING, WITH A TWENTY-FIVE (25)-FOOT 29 EASEMENT, BEING DESCRIBED AS PART OF THE SOUTH HALF, SOUTH 30 HALF, NORTHWEST QUARTER, SOUTHWEST QUARTER, SECTION 11, 31 TOWNSHIP 1 NORTH, RANGE 13 WEST, BEGINNING THIRTY (30) FEET 32 WEST AND 165 FEET NORTH OF THE SOUTHEAST CORNER OF SAID 33 SOUTH HALF, SOUTH HALF, NORTHWEST QUARTER, SOUTHWEST [Page 1 of 3] 1 QUARTER; THENCE NORTH TWENTY-FWE (25)FEET; THENCE NORTH 89 2 DEGREES 45 MINUTES WEST 201 FEET; THENCE SOUTH TWENTY-FIVE 3 (25) FEET; THENCE SOUTH 89 DEGREES 45 MINUTES EAST 201 FEET TO 4 THE POINT OF BEGINNING, FOR THE PURPOSE OF INGRESS AND 5 EGRESS. 6 LESS AND EXCEPT: 7 A TRACT OF LAND SITUATED IN THE SOUTH HALF OF THE SOUTH 8 HALF OF THE NORTHWEST QUARTER OF THE SOUTHWEST 9 QUARTER OF SECTION 11, TOWNSHIP 1 NORTH, RANGE 13 WEST, 10 PULASKI COUNTY, ARKANSAS, SAID TRACT OF LAND BEING MORE 11 PARTICULARLY BOUND AND DESCRIBED AS FOLLOWS; BEGINNING 12 AT A FOUND IRON PIN AT THE INTERSECTION OF THE EXISTING 13 WEST RIGHT-OF-WAY LINE OF JOHN BARROW ROAD WITH THE NORTH 14 RIGHT-OF-WAY LINE OF TANYA DRIVE; THENCE NORTH 88 DEGREES 15 14 MINUTES 34 SECONDS WEST ALONG SAID NORTH RIGHT-OF-WAY 16 LINE 22.62 FEET: THENCE ALONG THE PROPOSED WEST RIGHT-OF-WAY 17 LINE OF JOHN BARROW ROAD THE FOLLOWING COURSES AND 18 DISTANCES: NORTH 21 DEGREES 28 MINUTES 34 SECONDS EAST 41.61 19 FEET; THENCE NORTH 05 DEGREES 01 MINUTES 41 SECONDS WEST 75.54 20 FEET; THENCE NORTH 88 DEGREES 11 MINUTES 06 SECONDS WEST 15.00 21 FEET; THENCE NORTH 01 DEGREE 48 MINUTES 54 SECONDS EAST 22 25.76 FEET TO THE SOUTH LINE OF TRACT 9, MORRISS MANOR 23 ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, 24 ARKANSAS, AS RECORDED IN PLAT BOOK 28,PAGE 62: THENCE SOUTH 25 88 DEGREES 19 MINUTES 34 SECONDS EAST ALONG SAID SOUTH TRACT 26 LINE 32.68 FEET; THENCE SOUTH 01 DEGREES 50 MINUTES 26 SECONDS 27 WEST ALONG THE EXISTING WEST RIGHT-OF-WAY LINE OF" JOHN 28 • BARROW ROAD; SAID LINE LYING THIRTY (30) FEET WEST OF THE 29 CENTERLINE OF JOHN BARROW ROAD, 140.00 FEET TO THE POINT OF 30 BEGINNING. 31 Section 2. Funding for the project is from the 2013 Capital Improvement Bonds for Streets and 32 Drainage. The purchase price for the property is Eighty Thousand Dollars ($80,000.00). Cost for title 33 work, acquisition services, documents and environmental assessment work are included in the previously 34 authorized project amount. [Page 2 of 3] 1 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 2 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 3 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 5 resolution. 6 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same,that are inconsistent with 7 the provisions of this resolution,are hereby repealed to the extent of such inconsistency. 8 Section 5.
