3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF
4 COMPETITIVE BIDDING AND TO AUTHORIZE THE CITY MANAGER
5 TO PURCHASE A CURVED LED SIGN FOR THE CREATIVE
6 CORRIDOR'S MAIN STREET MALL BUILDING LOCATED AT 101
7 EAST CAPITOL AVENUE, IN THE CITY OF LITTLE ROCK,
8 ARKANSAS; AND FOR OTHER PURPOSES.

10 WHEREAS, it has been requested that the City Manager be authorized to dispense with the
11 requirement of competitive bids for the purchase of a Curved LED Sign to be located on the Creative
12 Corridor's Main Street Mall Building, located at 101 East Capitol Avenue. in the City of Little Rock,
13 Arkansas; and,
14 WHEREAS, the sign will be utilized to promote performances and other civic events much like the
15 former sign in the front of the Robinson Auditorium; and,
16 WHEREAS,Ace Sign Company of Little Rock has provided estimates on three(3)signs,all of which
17 were significantly less expensive than those from other vendors, and the price includes installation and a
18 five(5)-year warranty; and,
19 WHEREAS,ACE is a local company that can readily provide warranty or post-warranty service;and,
20 WHEREAS, the proprietary software will be the same as that used for the ticker tape sign approved
21 for purchase by the Board by the adoption of Resolution No.21,139 on December 1,2015,and will facilitate
22 the operation of the sign by the Little Rock Convention and Visitors Bureau Engineer; and,
23 WHEREAS, the cost of the sign including installation and a five (5)-year warranty is Fifty-Three
24 Thousand, Six Hundred and 60/100 Dollars($53,600.60), plus tax; and,
25 WHEREAS,the sign will be purchased using 100% grant funding from the ArtPlace Foundation.
26 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
27 OF LITTLE ROCK,ARKANSAS:
28 Section 1. Because the funds for this purchase come from a grant that does not require competitive
29 bids,the Board of Directors finds that it is impractical and unfeasible to submit this matter to a competitive
30 bid process and,therefore, dispenses with competitive bidding.
31 Section 2. The Board of Directors hereby authorizes the City Manager to dispense with the
32 requirement of competitive bids and to authorize the purchase of a Curved LED Sign to be installed on the
33 Creative Corridor's Main Street Mall Building, located at 101 East Capitol Avenue.

1 Section 3. The sign will be purchased using 100% grant funding from the ArtPlace Foundation, at a
2 cost of Fifty-Three Thousand, Six Hundred and 60/100 Dollars($53,600.60),plus tax.
3 Section 4. Funds for this purchase are available from Accounting Unit 270129,Activity Code G030166
4 and G030167.
5 Section 5. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph,
6 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
7 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this
8 ordinance,as if such invalid or unconstitutional provision were not originally a part of this ordinance.
9 Section 6. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this
10 ordinance are hereby repealed to the extent of such inconsistency.
