ROGERS EXCAVATING, INC., IN AN 5 AMOUNT NOT TO EXCEED TWO MILLION, FOUR HUNDRED 6 THIRTY-SEVEN THOUSAND, SIXTY-EIGHT DOLLARS ($2,437,068.00), 7 FOR MABELVALE CUTOFF IMPROVEMENTS; AND FOR OTHER 8 PURPOSES 9 10 WHEREAS, Bids were solicited for improvements along Mabelvale Cutoff Improvements from 11 Shiloh Drive to Mabelvale Main, Project No. 13-B-7A, Bid No. 15-025; and, 12 WHEREAS, James A. Rogers Excavating, Inc.., was the lowest responsive, responsible bid meeting 13 specifications. 14 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 15 OF LITTLE ROCK,ARKANSAS: 16 SECTION 1. The City Manager is hereby authorized to execute an agreement with James A. Rogers 17 Excavating,Inc., for the Mabelvale Cutoff Improvement Project in an amount not to exceed Two Million, 18 Four Hundred Thirty-Seven Thousand, Sixty-Eight Dollars($2,437,068.00),which is the base bid amount 19 of, Two Million, Thirty Thousand, Eight Hundred Ninety Dollars ($2,030,890.00), plus 20% 20 contingencies. 21 SECTION 2. Funding for this project is from the 2013 Capital Improvement Bonds for Streets and 22 Drainage as authorized by Resolution No. 13,699. 23 SECTION 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, 24 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 25 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 26 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 27 resolution. 28 SECTION 4. Repealer. All laws, ordinances; resolutions, or parts of the same, that are inconsistent 29 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency. 30 SECTION 5.
