7 WHEREAS, a Petition to form City of Little Rock Municipal Property Owners' Multipurpose;,.;v.%%'s
8 Improvement District No. 2015-320 (LaMarche Gardens Project) has been filed with the Little Rock City
9 Clerk;and,
10 WHEREAS,the City Clerk has presented the petition to the Mayor;and,
11 WHEREAS,the Mayor has set December 15,2015,at 6:00 PM as the date and time for a hearing before
12 the Little Rock Board of Directors for consideration of the petition; and,
13 WHEREAS, the Little Rock Board of Directors has determined from an abstractor's Certificate of
• 14 Property Ownership that those signing the petition constitute all the owners of the real property to be located in
15 said district; and,
16 WHEREAS,the Arkansas Municipal Property Owners'Improvement District Law provides that if the
17 governing body determines that all the owners of the real property to be located in the district have petitioned
18 for the improvements,it shall then be its duty by ordinance to establish and lay off the district as defined in the
19 petition and to appoint the commissioners named in the petition;
20 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
21 LITTLE ROCK,ARKANSAS:
22 Section 1. That the real property described in Exhibit "A" attached hereto and made a part hereof is
23 hereby established and laid off as City of Little Rock Municipal Property Owners'Multipurpose Improvement
24 District No.2015-320(LaMarche Gardens Project)for the purpose of constructing,either within or without the
25 boundaries of the District, if the property within the District will be benefited thereby, a sewage collection
26 . system, water distribution system, telephone service system, cable television service system, electrical
27 distribution system,natural gas distribution system,a system of roads and streets, including sidewalks,curbs
28 and gutters,underground drainage system,a system of street lighting,retaining walls,and landscaping,and all
29 trenching, excavating, grading and all construction associated with the installation of the above systems,
30 together with facilities related to any of the foregoing within said district.
31 Section 2. The following three individuals are hereby appointed as commissioners of said improvement
32 district:Peter H. Hornibrook, Robin J. Miller, and Kris Upton.

1 Section 3. The name of improvement district shall be City of Little Rock Municipal Property Owners'
2 Multipurpose Improvement District No.2015-320(LaMarche Gardens Project).
3 Section 4. The Board of Directors hereby determines that there is a need for additional infrastructure
4 within the City and hereby determines that the passage of this ordinance will facilitate construction of
5 additional infrastructure within the City. Therefore, an emergency is hereby declared to exist, and this
6 ordinance being necessary for the public health,safety and welfare shall be in full force and effect from and
7 after its passage and approval.
