HomeMy WebLinkAbout21139 1 ODINANCE NO. 21,139 2 3 AN ORDINANCE TO AUTHORIZE THE CITY MANAGER TO 4 PURCHASE A "TICKER TAPE" SIGN FOR THE CREATIVE 5 CORRIDOR'S MAIN STREET MALL BUILDING; TO DISPENSE 6 WITH COMPETITIVE BIDS; AND FOR OTHER PURPOSES. 7 8 WHEREAS, it has been requested that the City Manager be authorized to dispense with the 9 requirement of competitive bids for the purchase of a"ticker tape"sign to be located at Creative Corridor's 10 Main Street Mall Building at 101 East Capitol Avenue in Little Rock, Arkansas, and utilized to promote 11 performances and other civic events much like the former sign in the front of the Robinson Auditorium; 12 and, 13 WHEREAS, the purchase is 100% funded by an ArtPlace Foundation Grant to the City and ArtPlace 14 strongly encourages the City to obligate the funds by December 31,1015, or risk losing the funding; and, 15 WHEREAS,Ace Sign Company of Little Rock has provided estimates on three(3)signs,all of which 16 were significantly less expensive than those from other vendors, and the price includes installation and a 17 five (5)-year warranty and ACE is a local company that can readily provide warranty or post-warranty 18 service; and, 19 WHEREAS,the sign will be managed by the Little Rock Convention and Visitors Bureau Engineer, 20 who has found this system to be compatible with other systems presently being used and believes the ACE 21 product to be of superior price and quality as others he has investigated. 22 WHEREAS, the cost of the sign including installation and a five (5)-year warranty is Eighty-Six 23 Thousand,Eight Hundred Forty and 60/100 Dollars ($86,840.60),plus tax. 24 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 25 OF LITTLE ROCK,ARKANSAS: 26 Section 1. Because the funds for this purchase come from a grant that does not require competitive bids, 27 but does require that the monies be spent before the end of the current fiscal year, the Board of Directors 28 determines that it is unfeasible and impractical to submit this purchase contract to the normal competitive 29 bid process and,therefore,dispenses with such a requirement. 30 Section 2. The City Manager is authorized to enter into an agreement with ACE Sign Company for 31 the purchase of a"ticker tape" sign to be installed on the Creative Corridor's Main Street Mall Building at 32 101 East Capitol in an amount not to'exceed Eighty-Six Thousand,Eight Hundred Forty and 60/00 Dollars 33 ($86,840.60)plus tax. [Page 1 of 2] 1 Section 3. Funds for this purchase are available from Activity Code G030166/167. 2 Section 4. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 3 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 4 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this 5 ordinance, as if such invalid or unconstitutional provision were not originally a part of this ordinance. 6 Section 5. Repealer.
