3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENTS OF
4 COMPETITIVE BIDS AND TO AWARD COMCAST,INC., A CONTRACT
5 TO PROVIDE BROADBAND SERVICES TO TEN (10) LOCATIONS; TO
6 DECLARE AND EMERGENCY; AND FOR OTHER PURPOSES.

8 WHEREAS, in Little Rock, Ark., Resolution No. 14,180 (September 1, 2015), pursuant to a
9 competitive selection process it was determined that Comcast,Inc.,would provide broadband services and
10 equipment to the City for forty(40)of the fifty(50) sites that need to be provided; and,
11 WHEREAS, there were no successful bids for these nine (9) additional sites, and it was later
12 determined that one (1) additional site was needed, so after consultations with Comcast it has been
13 determined that they can perform the additional work; and,
14 WHEREAS, this works needs to be completed expeditiously, and the fact that the work will be done
15 by one contractor is better than to have two different companies helping to create a single system;
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS:
18 Section 1. The City Manager is authorized to enter into a contractual agreement for broadband interne
19 service with Comcast Cable Communications Management, LLC, d/b/a/ Comcast, for a term of three (3)
20 years,to provide services to the following locations:
21 a. Hindman Golf Course Main—60 Brookview Drive,Little Rock AR 72209
22 b.Hindman Golf Course Pro Shop—60 Brookview Drive,Little Rock AR 72209
23 c.Jim Dailey Fitness Center-300 South Monroe Street,Little Rock AR 72204
24 d.Landscape&Urban Forestry 3324 South Arch Street,Little Rock AR 72206
25 e. MacArthur Museum Of Arkansas Military Museum-509 East 9th Street,Little Rock AR 72202
26 f.Asher Avenue Parks Maintenance Shop-9009 Asher Avenue,Little Rock AR 72209
27 g.Rebsamen Tennis Center— 1501 Leisure Place,Little Rock AR 72204
28 h.Rivermarket Police Kiosk—400 President Clinton Avenue,Little Rock AR 72201
29 i. West Central Alert Center 4200 John Barrow Road, Suite C., Little Rock AR 72204
30 j. Fire Training Facility 7000 Murray Street,Little Rock AR 72209
31 Section 2. The total three (3)-year cost for this work is Forty-Six Thousand, Two Hundred Sixteen
32 Dollars($46,216.00)plus taxes and fees and will come from each Department's Operational Budget.

1 Section 3. Because of the need to get this work completed quickly, and the fact that one(1)entity is
2 already in place to provide most of this broadband infrastructure work to the City, the Board of Directors
3 declares that it is impractical and unfeasible to bid for these nine sites; therefore, the requirement of
4 competitive selection is waived.
5 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase or
6 word of this ordinance is declared or adjudged to be invalid or unconstitutional such declaration or
7 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
8 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
9 ordinance.
10 Section 5. Repealer. All laws,ordinances,resolutions,and parts of the same that are inconsistent with
11 the provisions of this ordinance are hereby repealed to the extent of such inconsistency including, but not
12 limited to,Little Rock,Ark.,Resolution No. 14,180(September 1,2015).
13 Section 5. Emergency Clause. The ability to complete and activate broadband infrastructure to
14 assist with City data transmission is essential to the public health, safety and welfare, and the ability to
15 contractquickly with a supplier to complete the build out including these nine sites is even more critical;
16 an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and
17 after the date of its passage.
