3 A RESOLUTION TO AUTHORIZE USE OF EMINENT DOMAIN TO
4 ACQUIRE THE MABELVALE CUTOFF ROAD RECONSTRUCTION
5 PROJECT (FAIRWOOD TO CHICOT); AND FOR OTHER PURPOSES.
7 WHEREAS, attempts to acquire some right -of -way, permanent construction
8 easements, and temporary construction easements necessary for construction of
9 Mabelvale Cutoff Road (Fairwood to Chicot) have been unsuccessful; and
10 WHEREAS, efforts will continue to acquire necessary property without the use of
11 eminent domain.
12 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
13 THE CITY OF LITTLE ROCK, ARKANSAS:
14 Section 1. The City is authorized to use eminent domain to complete acquisition
15 of right -of -way for this project.
16 Section 2. Funding for this property is available in account 301 - 220 -Z004 .
17 Section 3. This resolution shall be in full force and effect from and after its
18 adoption.
