2 A RESOLUTION TO AUTHORIZE USE OF EMINENT DOMAIN TO
3 ACQUIRE THE 28th STREET (COMMERCE TO CUMBERLAND) & 29TH
4 STREET (FULTON TO IZARD) STREET IMPROVEMENTS PROJECT;
5 AND FOR OTHER PURPOSES.
6 WHEREAS, attempts to acquire some right -of -way and temporary construction
7 easements necessary for construction of the 281h Street (Commerce to Cumberland) &
8 29th Street (Fulton to Izard) Street Improvements Project have been unsuccessful; and
9 WHEREAS, efforts will continue to acquire necessary property without the use of
10 eminent domain.
11 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
12 THE CITY OF LITTLE ROCK, ARKANSAS:
13 Section 1. The City is authorized to use eminent domain to complete acquisition
14 of right -of -way and temporary construction easements for this project.
15 Section 2. Funding for this property is available in account 314 - 220 -SR04 and
16 314 - 220 -SR05.
17 Section 3. This resolution shall be in full force and effect from and after its
18 adoption.
