3 AN ORDINANCE TO ABANDON APPROXIMATELY 570 LINEAR-FEET
4 OF THE UNDEVELOPED SIXTY (60)-FOOT WIDE ROCK CREEK
5 RIGHT-OF-WAY, WHICH RUNS NORTH FROM WEST 36TH STREET,
6 APPROXIMATELY 700 FEET EAST OF BOWMAN ROAD (G-23-454),IN
7 THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER
8 PURPOSES.

10 WHEREAS,a request was made to abandon approximately 570 linear-feet of the undeveloped sixty
11 (60)-foot wide Rock Creek Way right-of-way,which runs north from West 36th Street, approximately 700
12 feet east of Bowman Road, pursuant to the City's general Police Power Authority under Ark. Code Ann.
13 § 14-54-104; and,
14 WHEREAS,the Board has determined all adjacent property owners have agreed to the abandonment
15 request and no other property owners are required to be notified of the abandonment request;and,
16 WHEREAS, none of the utility companies object to the abandonment request and none request an
17 easement;and,
18 WHEREAS, Public Works has reviewed the abandonment request and has stated that ease na Ll ,,,,, ~~~

22 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF- : '_" ` h;
23 OF LITTLE ROCK,ARKANSAS:
24 Section 1. The Board of Directors hereby releases, vacates, and abandons approximately 570 linear-
25 feet of the undeveloped sixty (60)-foot wide Rock Creek Way right-of-way, which runs north from West
26 36th Street,approximately 700 feet east of Bowman Road.
27 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
28 records of the recorder of the Circuit Clerk in Ex-Officio Recorder of Pulaski County,Arkansas.
29 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
30 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
31 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
32 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
33 of the ordinance.

1 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
2 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
