3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO.
4 13,998 (NOVEMBER 3, 2014) TO AUTHORIZE THE CITY MANAGER
5 TO ENTER INTO A CONTRACT WITH OAKLEY FERTILIZER, INC.,
6 FOR THE PURCHASE OF TREATED ROCK SALT IN BULK FOR THE
7 PUBLIC WORKS DEPARTMENT OPERATIONS DIVISION; AND FOR
8 OTHER PURPOSES.

10 WHEREAS, the Public Works Department Operations Division utilizes treated rock salt during
11 adverse winter weather to remove snow and ice from the roadways; and,
12 WHEREAS, the Public Works Department has obtained a bid quote from Oakley Fertilizer, Inc.,
13 being One Hundred Twenty Dollars ($120.00) per ton as needed, and has also consulted with the
14 Arkansas Highway & Transportation Department (AHTD Bid Contract No. H-15-218J) with Oakley
15 Fertilizer, Inc., being the lowest responsible bidder meeting specifications; and,
16 WHEREAS, on November 3, 2014, the Board of Directors adopted Resolution No. 13,998 to
17 authorize the City Manager to enter into a contract with Oakley Fertilizer, Inc., for the purchase of treated
18 rock salt in bulk for the Public Works Department Operations Division at a cost of One Hundred Twenty
19 Dollars ($120.00) per ton, as needed, in an amount not to exceed One Hundred Fifty Thousand Dollars
20 ($150,000.00) per year, to be utilized during winter weather to remove snow and ice from the roadways;
21 and,
22 WHEREAS, due to recent extended winter weather, and to ensure the ability to purchase necessary
23 treated rock salt for future adverse winter weather to remove snow and ice from the roadways, it is now
24 necessary to amend Resolution No. 13,998 to increase the contract not to exceed amount to Three
25 Hundred Thousand Dollars ($300,000.00) per year for the purchase of treated rock salt in bulk for the
26 Public Works Department Operations Division to be utilized during winter weather to remove snow and
27 ice from the roadways.
28 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
29 OF LITTLE ROCK,ARKANSAS:
30 Section 1. Section 1 of Little Rock, Ark., Resolution No. 13,998 (November 3, 2014) is hereby
31 amended to state the following:
32 The Board of Directors hereby authorizes the City Manager to enter into a contract with
33 with Oakley Fertilizer, Inc., for the purchase of treated rock salt in bulk for the Public

1 Works Department Operations Division at a cost of One Hundred Twenty Dollars
2 ($120.00) per ton, as needed, in an amount not to exceed Three Hundred Thousand
3 Dollars ($300,000.00) per year, to be utilized during winter weather to remove snow and
4 ice from the roadways.
5 Section 2. Funds for this purchase are allocated in Account: Streets & Drainage Maintenance #200-
6 040-003-61020.
7 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
8 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
9 adjudication shall not affect the remaining portions of the resolution, which shall remain in full force and
10 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
11 resolution.
12 Section 4. Repealer. All laws, ordinances, resolutions, bylaws, or parts of same, particularly Little
13 Rock, Ark., Resolution No. 13,998 (November 3, 2014), that are inconsistent with this resolution are
14 hereby repealed to the extent of such inconsistency.
15 Section 5. This Resolution shall be in full force and effect from and after its adoption.
