3 AN ORDINANCE TO AMEND CHAPTER 8 OF THE 1988 LITTLE ROCK
4 CODE OF ORDINANCES TO REVISE PERMIT FEE SCHEDULES FOR
5 BUILDING, ELECTRICAL, PLUMBING, MECHANICAL AND
6 RELATED WORK PERFORMED IN THE CITY OF LITTLE ROCK,
7 ARKANSAS; TO DECLARE AN EMERGENCY; AND FOR OTHER
8 PURPOSES.

10 WHEREAS, permit fee schedules for building, electrical, plumbing, mechanical and other related
11 work performed in the City were last established pursuant to Little Rock, Ark. Ord. No. 19,458
12 (December 13,2005), and
13 WHEREAS, the City Board of Directors has determined that due to increased costs for
14 administration and inspection under the Building and Safety Codes over the past decade, the permit fee
15 schedules should be revised as recommended by the Planning and Development Department.
16 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS.
18 Section 1. The language in Section 8-31(c) of the 1988 Little Rock Code of Ordinances is hereby
19 deleted and replaced with the following language:
20 (c)Fees. The following are hereby established as permit fee schedules for building, electrical,
21 plumbing, mechanical and other related work in the City.
22 I. Building Permit Fees, Miscellaneous Fees and General Regulations
23 A. Permit Fees. Permits are required for any work that exceeds Five Hundred Dollars
24 ($500.00), including material and labor, or that requires an inspection, but painting,
25 floor coverings and cosmetic changes are excluded. Proper documentation, i.e., copy
26 of contract or letter of affidavit from applicant, must be presented when obtaining a
27 permit. If documentation is not present or cannot be obtained, the latest building
28 valuation data chart as published by the International Code Council will be used in
29 determining permit fees. Fees on work requiring a building permit as set forth in the
30 Building and Safety Codes adopted by the City shall be paid as required at the time
31 of filing an application.

1 Total Valuation Fee
2 $500 and less No fee, unless inspection required, in which
3 case, a $20.50 fee for each inspection shall
4 charged
5 $500.01 to $50,000 $31.00 for the first $500.00, plus $3.60 for
6 each additional thousand or fraction thereof,
7 to and $50,000.00
8 $50,000.01 to $500,000 $203.80 for the first $50,000.00, plus $2.47
9 for each additional thousand or fraction
10 thereof, to and including$100,000.00.
11 $100,000.01 to$500,000 $327.30 for the first $100,000.00, plus $2.16
12 for each additional thousand or fraction
13 thereof, to and including$500,000.00.
14 Over$500,000 $1,191.300 for the first $500,000.00, plus
15 $1.65 for each additional thousand or
16 fraction thereof.
17 B. Minimum Fee. Minimum fee for any Building Permit, except as otherwise specified,
18 shall be Thirty-One Dollars($31.00).
19 C. Commercial Plan-Checking Fee. When the valuation of the proposed construction
20 exceeds Five Hundred Dollars ($500.00) and a plan is required to be submitted in
21 accordance with the Arkansas Fire Prevention Code, a Plan-Checking Fee shall be
22 paid to the Building Codes Division at the time of submitting plans and specifications
23 for checking. Said Plan-Checking Fee shall be equal to one-half of the Building
24 Permit Fee. Minimum fees shall be Fifty Dollars ($50.00) for new construction
25 (added square-feet) repair, remodels and miscellaneous permits requiring plan
26 review. Such plan-checking fee is in addition to the Building Permit Fee and is non-
27 refundable.
28 D. Data processing fee. The following is hereby established as the data processing fee
29 schedule for building, electrical, plumbing, mechanical and other related work in the
30 City. Collected fees shall be placed in a separate account and shall be used for the
31 purpose of purchasing and maintaining data processing equipment, software and to
32 provide general training for building codes staff. All purchases, training and travel
33 shall not be made without prior written approval from the director of planning and

1 development. The data processing fee is in addition to the permit charge and is non-
2 refundable.
3 Classification of Work Fee
4 Residential $4.00
5 Commercial $6.00
6 E. Act 474 of 1999 Surcharge. As required by Act 474 of 1999, a surcharge of$0.50 per
7 each One Thousand Dollars ($1,000.00) of construction authorized on any non-
8 residential construction permit issued by the City will be imposed to financially
9 support the craft training education program, with a maximum surcharge to be One
10 Thousand Dollars($1,000.00).
11 F. Inspection Fees for Moving of Houses, HUD-Certified Manufactured Homes, and
12 Modular Buildings:
13 Moving structure off lot $100.00
14 Moving structure on same lot 50.00
15 Required inspection before move inside City 35.00
16 Required inspection before move from City 50.00
17 from Pulaski County of adjacent County
18 Required inspection for move to City from 100.00
19 outside adjacent Counties, but in the (plus $0.35 per mile
20 State of Arkansas, or from out of State round trip plus
21 expenses)
22 G. Demolition of Structure. $0.0825/square-foot of floor area. Minimum Fee of Thirty-
23 One Dollars ($31.00). Demolition Permit shall expire one (1)-year from issuance
24 date except in cases where structure is declared to be an imminent danger.
25 H. Blasting Fee. In addition to insurance and bond as required in Ordinance No. 11,361,
26 a permit fee of One Hundred Dollars ($100.00) for the first day and Fifty Dollars
27 ($50.00) for each additional day shall be charged.
28 I. Parking Lot Fees. A minimum routing fee of Fifty Dollars($50.00) shall be charged
29 and permit fees shall be assessed as set forth in subsection 8-31(c)I.A.
30 J. Construction Shack or Field Office. Fee of Thirty-One Dollars ($31.00) with site
31 plan. Fee waived if included with permit application.
32 K. Tent Permit. Fee of Thirty-One Dollars ($31.00) upon proper completion of Fire
33 Department Approval Form.

1 L. Swimming Pools. Fees assessed per Subsection 8-31(c)I.A, but minimum fee shall be
2 Fee of Thirty-One Dollars($31.00).
3 M. Fuel Tank or Pump. Each (new or replacement)will be Thirty-One Dollars($31.00).
4 N. Miscellaneous Permit Fees. Satellite dishes,towers and cell sites, fire alarm systems,
5 fences and any other miscellaneous permit, unless previously outlined, shall be
6 assessed as set forth in Subsection 8-31(c)I.A.
7 Retaining walls four (4) feet or more in height specifically used for retaining dirt or
8 fill shall be designed, approved and stamped by a licensed design professional at time
9 of application in accordance with the current City-adopted Building Codes. Fees
10 shall be as set forth in Subsection 8-31(c)I.A.
11 O. Investigative Fee. In those instances wherein the information submitted to obtain a
12 permit is inadequate or incomplete, or work has begun without a permit, or an
13 inspection is required to determine the"on-site"conditions prior to issuance or denial
14 of a permit, the Building Codes Division may charge the owner an investigative fee
15 of Forty-One Dollars($41.00). The payment of the investigative fee shall not exempt
16 any person from compliance with the provisions of the code, or from any penalty
17 prescribed by law.
18 P. Re-Inspection Fee. A re-inspection fee of Forty-One Dollars($41.00) will be charged
19 when an additional trip is made by an inspector due to rejections, lockouts,
20 insufficient information as to location of building or structure, work not ready for
21 inspection, or any other cause due to neglect or failure on the part of the applicant.
22 Q. Penalties (Working Without a Permit). Where work for which a permit is required by
23 a current City-adopted Building or Safety Code or a provision of the City Code is
24 started or proceeded prior to obtaining said permit, the fee herein specified shall be
25 tripled; however, payment of such triple fee shall not relieve any person from fully
26 complying with the requirements of the such codes in the execution of the work nor
27 from any penalties prescribed herein and no additional permits shall be granted until
28 all fees have been paid.
29 R. Copy Fees.
30 1. Duplicate permit card (lost, stolen, misplaced, etc.) $5.00 per card
31 2. Permit background computer readout 1.00 per copy
32 3. Copier fees 0.11 per copy
33 4. Duplicate copy of certificate of occupancy 10.00 per copy

1 S. Construction Board of Appeals and Adjustments Applications (Building, Electrical,
2 Plumbing and Mechanical). A fee of One Hundred Dollars ($100.00) shall be
3 included with each Construction Board of Appeals and Adjustments application.
4 T. Expiration of Permits/Permit Refunds.
5 1. All permits issued by the building codes division with a valuation of Five
6 Hundred Thousand Dollars ($500,000.00) or less shall expire one (1)-year from
7 the date of issuance. Extensions of up to ninety (90) days after the expiration
8 date may be granted for each permit. The request for extension must be in
9 writing to the Building Codes Division and must show just cause. A fee of
10 Thirty-One Dollars ($31.00) shall be assessed for each ninety(90)-day extension.
11 2. All permits issued by the Building Codes Division with a valuation of over Five
12 Hundred Thousand ($500,000.00) shall expire two (2) years from the date of
13 issuance. Extensions of up to ninety (90) days after the expiration date may be
14 granted for each permit. The request for extension must be in writing to the
15 Building Codes Division and must show just cause. A fee of Thirty-One Dollars
16 ($31.00) shall be assessed for each ninety(90)-day extension.
17 3. All permits shall become invalid if work authorized is not commenced within six
18 (6) months of permit issue date, or if the work authorized is suspended or
19 abandoned for a period of six(6) months after work is commenced. Before work
20 can be resumed, a new permit must be obtained. The permit fee shall be one-half
21 the amount required for a new permit, provided no changes have been made in
22 the original plans and specifications for such work, and provided that suspensions
23 or abandonment have not exceeded six(6)months.
24 4. A permittee holding an unexpired permit may apply for a one-time extension,
25 provided he can show good and satisfactory reason, and beyond his control the
26 work cannot be commenced within the six (6)-month period from the issue date.
27 In order to renew work on a permit after it has expired, the permittee shall pay a
28 fee in accordance with Subsection 8-31(c)I.T.1 or 8-31(c)I.T.2.
29 5. In cases where a change in contractor is made prior to completion of the job. The
30 permit fee shall be assessed based on the stage of approval of inspections. The
31 fee assessment shall be prorated in accordance with the number of remaining
32 inspections. Inspections consist of the following:
33 Building: Footing, Framing, Final
34 Electrical: Pipe-In Wall, Rough, Final

1 Plumbing: Slab, Rough, Final
2 Mechanical: Duct Work, Rough, Final
3 6. Permit refunds issued in accordance with Finance Department guidelines.
4 U. Temporary Certificate of Occupancy Ninety (90)Days
5 A. Commercial. $50.00
6 Single buildings, apartments, motels, hotels and multi-tenant occupancies when
7 permitted under same contractor or owner shall be assessed as follows: Fifty
8 Dollars ($50.00) for the first five (5) units and Ten Dollars ($10.00) for each
9 additional unit. A one-time extension of thirty (30) days may be granted if
10 applicant can show just cause for temporary certificate of occupancy to be
11 extended. Applicant shall pay extension fee of Thirty-One Dollars ($31.00) for
12 each extension request.
13 B. Residential. $31.00
14 Temporary certificate of occupancies issued for residential occupancies shall
15 expire ninety (90) days from date of issuance. A one-time extension of thirty
16 (30) days may be granted if applicant can show just cause for temporary
17 Certificate of Occupancy to be extended. Applicant shall pay extension fee of
18 Thirty-One Dollars($31.00) for each extension request.
19 Failure to obtain a permanent Certificate of Occupancy after expiration of a
20 temporary certificate of occupancy may result in issuance of a citation for
21 appearance in Little Rock District Court. This may also include disconnection of
22 utilities. Fines for occupying a structure without a permanent certificate of
23 occupancy may be assessed up to Two Hundred and Fifty Dollars ($250.00) per
24 day for each occurrence.
25 II. Electrical Permit Fees
26 A. New Construction.
27 1. One-and Two(2)-Family Dwelling: 0.0825/square-foot under roof
28 2. All other occupancies: As set forth in the unit cost schedules in Subsection 8-
29 31(c)I I.C.
30 B. Repair/Alteration/Addition to Existing Construction.

23 D. Temporary Power Requirements. Before any power is supplied to the permanent
24 distribution system of a building under construction, written notice must be
25 submitted to this office noting the length of time the temporary power will be
26 needed before the final electrical inspection is made, the understanding that the
27 structure will not be occupied until after the final inspection, and that the party
28 submitting the request will assume liability of any damage incurred as a result of
29 disconnection of power from the building as a result of a violation of this
30 ordinance. The time limit on temporary power being furnished to the building
31 will be determined on the basis of need, not to exceed thirty (30) days. An
32 extension of time may be granted only by special permission.

1 After release for connection to electrical service, if connection is not made within
2 six(6) months, a new meter loop permit and inspection approval will be required
3 before release.
4 E. Expiration of permits shall be assessed as provided in Subsection 8-31(c)I.T.
5 F. Minimum fee for permit for electrical work shall be Thirty-One Dollars($31.00).
6 G. Work with No Permit. In case it shall be discovered that any electrical work has
7 been installed or put into use for which no permit has been issued, the violator
8 shall pay a fee equal to three (3) times the permit fee which shall have been paid
9 for work done in violation thereof and no additional permits shall be granted until
10 all fees have been paid.
11 III. Plumbing Permit Fees
12 A. New Construction.
13 1. One-and Two(1)-Family Dwellings: $0.0825/square-foot under roof
14 2. All other occupancies:
15 As set forth in the unit cost schedules in Subsection 8-31(c)III.B.
16 B. Repair/Alterations/Addition to Existing Construction.
17 1. Unit Costs—Each Plumbing Fixture Outlet or Appliance $ 5.15
18 Shall include each water closet, urinal, bidet, sink, lavatory, basin, laundry sink,wash
19 tray, beer or soda fountain, bath tub, hot tub, shower, sauna, drinking fountain, wet
20 bar, washing machine, hose cabinet or hose rack, fire pump, sewer ejector, cooling
21 tower, sill cock, dental unit, hub drain, floor, area or roof drain, sand trap, grease trap,
22 sump pump or any other plumbing element commonly known as plumbing fixture.

12 charge.
13 E. Minimum fee for any permit for plumbing work shall be Thirty-One Dollars($31.00)
14 F. Work with No Permit. The penalty for failure to obtain a permit for work as called for
15 in City Code shall be as described in the penalty section of this code, and in addition
16 to any such fine or imprisonment as may be imposed pursuant to said penalty section,
17 the violator shall pay a fee equal to three (3) times the permit fee that was paid for
18 work done in violation hereof.
19 IV. Heating/Air Mechanical Permit Fees
20 A. New Construction.
21 1. One- and Two-Family Dwelling: $0.0825/square-foot
22 2. All other occupancies. As set forth in the cost schedules in Subsection 8-
23 31(c)IV.B.
24 B. Commercial and Residential Replacements, Repairs, Alterations and Additions.
25 1. Total Valuation Mechanical Fee Schedule
26 $500 and less No fees, unless inspection required, in which
27 case a $20.50 fee for each inspection shall
28 be charged.
29 $500.01 to $500,000 $31.00 for the first $500.00 up to $1,000.00,
30 plus $5.15 for each additional thousand or
31 fraction thereof, to and including
32 $500,000.00.
33 $500,000.01 to $1,000,000 $2,569.85 for the first $500,000.00, plus
34 $4.10 for each additional thousand or

6 Boiler Permits are issued only with proof of special boiler license.

10 C. Minimum Fee for any Hearing/Air or Mechanical Permit shall be Thirty-One Dollars
11 ($31.00)
12 D. Expiration of permits are addressed as per conditions of Subsection 8-31(c)I.S.
13 E. Work located out of City limits shall be charged a surcharge of 50% of total permit
14 charge.
15 F. Penalties (Working Without a Permit). Where work for which a permit is required by
16 the Arkansas Mechanical Code is started or proceeded prior to obtaining said permit,
17 the fee herein specified shall be tripled; however, payment of such triple fee shall not
18 relieve any person from fully complying with the requirements of the Arkansas
19 Mechanical Code in the execution of the work nor from any penalties prescribed
20 herein and no additional permits shall be granted until all fees have been paid.
21 Section 2. Repealer. The provisions of all technical codes, ordinances and codes of ordinances in
22 conflict with the provisions of this ordinance are hereby repealed.
23 Section 3. Emergency; effective date. The ability to properly inspect and permit construction-
24 related work in the city and to assure proper funding for such inspections is essential to the public, health,
25 safety and welfare. The effective date of this ordinance shall be January 1, 2015.
