HomeMy WebLinkAbout20947 1 ORDINANCE NO. 20,947 2 3 AN ORDINANCE TO DISPENSE WITH COMPETITIVE BIDS; TO 4 AWARD A MAINTENANCE AGREEMENT TO MOTOROLA, INC., IN 5 THE AMOUNT OF FIVE HUNDRED THIRTY-THREE THOUSAND, 6 FOUR HUNDRED NINETY-ONE AND 90/100 DOLLARS ($533,491.90), 7 INCLUDING TAX; TO AUTHORIZE THREE (3) ADDITIONAL 8 ANNUAL EXTENSIONS OF THIS AGREEMENT AT THE DISCRETION 9 OF THE CITY MANAGER; TO DECLARE AN EMERGENCY; AND FOR 10 OTHER PURPOSES. 11 12 WHEREAS, the City has utilized a Motorola system for its emergency communications, and it has 13 been necessary to have a maintenance agreement for the system infrastructure which includes portable 14 and mobile radios used by the Little Rock Police Department; and, 15 WHEREAS, the last ordinance to authorize the maintenance contract for the Motorola system was 16 awarded to Grace Communications Company of North Little Rock, Arkansas, the only communications 17 company in the Central Arkansas area which has the trained personnel, proprietary software, and test 18 equipment readily available to properly maintain the City's radio network infrastructure and is the local 19 service provider for Motorola, Inc.; and, 20 WHEREAS, the last such contract for this service was authorized in Little Rock, Ark., Ordinance 21 No. 20,158 (September 15,2009), and it is now time to enter into another agreement; and, 22 WHEREAS, as long as it can be certified to the City Manager that Grace Communications Company 23 of North Little Rock is the only local authorized dealer available to provide this service, then an annual 24 resolution upon recommendation of the City Manager should be sufficient for the renewal of this 25 agreement; 26 NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 27 OF LITTLE ROCK,ARKANSAS: 28 Section 1. The City Manager is authorized to enter into a service agreement in the amount of Five 29 Hundred Thirty-Three Thousand, Four Hundred Ninety-One and 90/100 Dollars($533,491.90), including 30 tax, with Grace Communications Company of North Little Rock to provide maintenance to the City's 800 31 mHz Radio System. 32 Section 2. Because of the need to have a local provider of these maintenance services authorized by 33 Motorola, Inc., and Grace Communications Company of North Little Rock is the only such provider, the !Page 1 of21 1 Board declares that it is impractical and unfeasible to submit this matter to a competitive bid process, and, 2 therefore,waives competitive bidding. 3 Section 3. As long as Grace Communications Company of North Little Rock is the only local 4 provider of maintenance services for Motorola, Inc., equipment used by the City in its 800 mHz 5 Emergency Services Equipment, an annual resolution to add an additional year to the agreement is 6 authorized by this ordinance, and to establish the consideration for such a contract, is all the legislative 7 authority required, provided the City Manager certifies to the Board of Directors that there is no other 8 local provider of this services, and provided further than no such additional agreement will be for more 9 than a one(1)-year period of time, with a limit of three(3)additional annual extensions. 10 Section 4. Funds for the specific agreement authorized by this ordinance are available in the City's 11 9-1-1-fund. 12 Section 5. Severability. In the event any portion of this ordinance is declared or adjudged to be 13 invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this 14 ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or 15 unconstitutional were not originally a part of this ordinance. 16 Section 6. Repealer. All ordinances and resolutions,and parts thereof, which are in conflict with any 17 provision of this ordinance are hereby repealed to the extent of such conflict. 18 Section 8. Emergency.
