'� t ed: 10!22/2014 3:22:46 PM O; yep . {, Recorded: 10/22/2014 03:29:06 P �� : Recorded in Official Records of 1 ar 'I� & Q; `' = PULASKI COUNTY CIRGUIT/COUNT Crane. 1 tr,'• •"" zORDINANCE N0. 20,943 Fee s2o.00 CLERK 2 CO'1N 3 AN ORDINANCE TO REPEAL ORDINANCE NO. 20,800 (OCTOBER 1, 4 2013) TITLED MACARTHUR COMMONS SHORT-FORM PCD (Z-1718- 5 D), LOCATED IN THE 400 BLOCK OF EAST CAPITOL AVENUE 6 BETWEEN RIVER MARKET AVENUE AND ROCK STREET AND TO 7 REVOKE A PLANNED ZONING DISTRICT; AND FOR OTHER 8 PURPOSES. 9 10 WHEREAS, Ordinance No. 20,800 was passed on October 1, 2013, establishing a PZD, Planned 11 Zoning District,titled MacArthur Commons Short-Form PCD(Z-1718-D), located in the 400 block of East 12 Capitol Avenue between River Market Avenue and Rock Street; and, 13 WHEREAS,the multi-family and commercial development approved for MacArthur Commons Short- 14 Form PCD (Z-1718-D), located in the 400 block of East Capitol Avenue between River Market Avenue 15 and Rock Street, is no longer required since the development of multi-family is proposed within the 16 allowable density of the underlying zoning district and the owner of the subject property has requested the 17 repeal of the PZD ordinance and restoration of the zoning classification as previously existed; and, 18 WHEREAS,the Little Rock Planning Commission reviewed the request for revocation for MacArthur 19 Commons Short-Form PCD (Z-1718-D)at their October 1, 2013, Public Hearing and voted 9 ayes, 0 nays 20 and 2 absent to forward the revocation request to the Little Rock Board of Directors for final action. 21 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 22 OF LITTLE ROCK,ARKANSAS. 23 Section 1. That Ordinance No. 20,800 is hereby repealed, removing from the official zoning map the 24 classification PCD, Planned Commercial District. 25 Section 2. That the underlying UU,Urban Use District,zoning classification is restored to the property 26 described as: 27 A tract of land being a part of Block 149,Original City of Little Rock,Arkansas,and 28 a part of Block 17, Pope's Addition to the City of Little Rock, Arkansas, and a part 29 of a strip of land which was formerly platted as an alley which lies between said Bock 30 149,Original City of Little Rock,Arkansas,and Block 17,Pope's Addition to the City 31 of Little Rock,Pulaski County,Arkansas,also being a part of Section 2,Township 1 32 North, Range 12 West, Pulaski County, Arkansas being particularly described as 33 follows: Beginning at a Melburgher No. 3 Monument, being the southwest corner of [Page 1 of 21 1 Block 140,Original City of Little Rock,Arkansas, run thence along the east right-of- 2 way line of Rock Street (sixty (60)-foot right-of-way) 147.25 feet to a point; thence 3 leaving said right-of-way line,S80°35'49E,212.03 feet to a point;thence S09°24'19"W 4 8.00 feet to a point; thence S80°35'49"E 86.83 feet to a point on the west right-of-way 5 line of River Market Avenue (sixty (60)-foot right-of-way); thence along said right- 6 of-way line S09°24'19"W, 139.25 feet to a set chiseled scribed "X" in concrete on the 7 north right-of-way line of East Capitol Street (eighty (80)-foot right-of-way), said 8 point also being the southeast corner of Block 17,Pope's Addition; thence along said 9 right-of-way line,N80°35'49"W,300.86 feet back to the point of beginning said tract 10 containing 43,591 square feet or 1.001 acres, more or less. 11 Section 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, 12 Arkansas,and designated district map be and is hereby amended to the extent and in the respects necessary 13 to affect and designate the change provided for in Sections 1 and 2 hereof. 14 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 15 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 16 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 17 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 18 ordinance. 19 Section 5. Repealer.
