HomeMy WebLinkAbout20934 2014054747 Received: Recorded: 09/19/2014 11:27:27� 01AM4 11:23:52 Fi ed g,AM \\ r✓IRC' (/�T OF• x » Recorded in Official RecordsO of Lar � � '• "'�`��,� �'• • O%: PULASKI COUNTY CIRCUIT/COUNTY CLERK `N•• j ' Fees $20.00 _ W .° ' 'r' 1 2 ORDINANCE NO. 20,934 , _• ��P OUNTY, F ,‘ 3 4 AN ORDINANCE CONDEMNING CERTAIN STRUCTURES IN THE 5 CITY OF LITTLE ROCK AS STRUCTURAL, FIRE AND HEALTH 6 HAZARDS; PROVIDING FOR SUMMARY ABATEMENT 7 PROCEDURES; DIRECTING THE CITY MANAGER TO TAKE SUCH 8 ACTION AS IS NECESSARY TO RAZE AND REMOVE SAID 9 STRUCTURES; DECLARING AN EMERGENCY; AND FOR OTHER 10 PURPOSES. 11 12 WHEREAS, certain structures in the City of Little Rock, Arkansas, have become rundown, 13 dilapidated, unsightly, dangerous and detrimental to the public welfare of the citizens of Little Rock; and 14 WHEREAS, the condition of these structures constitutes a serious structural, fire and health hazard; 15 and 16 WHEREAS, such structures are a public nuisance and are dangerous to the health and safety of the 17 occupants or other persons and, further, are in such condition as to be dangerous to the lives, limbs and 18 property of people in its vicinity or those lawfully passing thereby; and 19 WHEREAS, such structures are declared a nuisance and immediate action is necessary to remedy 20 these situations and said buildings should be rehabilitated by the owners or razed either by the owners or 21 the City of Little Rock,Arkansas. 22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE 23 CITY OF LITTLE ROCK,ARKANSAS: 24 SECTION 1. The Board of Directors hereby declares that the following structures constitute public 25 nuisances. The owners of the following described property are hereby ordered to immediately contact the 26 Planning and Development Department, Building Codes Division and entering into an agreement 27 providing for the immediate razing and removal of said structures within twenty-four (24) hours and to 28 complete such removal within seventy-two (72) hours of the effective date of this ordinance. While not 29 required by law to do so, the Planning and Development Department, Building Codes Division will 30 immediately attempt to notify the owners of the property listed below of the passage of this ordinance by 31 certified mail or personal service. 32 The property on which the condemned structures are located by street address and legal 33 description is hereafter set forth with the name of the owners of record, as follows: IPage 1 of 31 1 1. 8500 Mize Road; Owner: Brandon Kearney 2 1315 South Bois D Arc, Pine Bluff, Arkansas 71603 3 Legal: S 264' OF E 773 3' OF NW SE LESS & EXEC 6360 SQ FT FOR RD PER DEED 2000- 4 0044 5 Parcel ID#34L-432-00-105-00 6 Ward 2 7 Zoning Classification: R-2 8 Status: Closed former Nursing Home 9 10 SECTION 2. The conditions of the structure on the above-described property have been found to 11 present structural, fire and health hazards and are dangerous to the health and safety of the occupants or 12 other persons, and further, the structure is in such conditions as to be dangerous to the lives, limbs and 13 property of people in its vicinity or those lawfully passing thereby. 14 SECTION 3. The City Attorney is hereby authorized to institute such proceedings against such 15 persons as may be necessary in order to enforce the provisions of this ordinance so as to remedy the 16 unsightly and dangerous conditions brought about as a result of the failure of the owner thereof to maintain 17 this property. 18 SECTION 4. The Planning and Development Department, Building Codes Division of the City of 19 Little Rock, Arkansas, is also authorized to raze and remove said building and file and enforce a lien 20 against said property for the cost of razing and removing said structure pursuant to Section 20-32 of the 21 Little Rock Code of Ordinances. 22 SECTION 5.
