HomeMy WebLinkAbout20920 1 ORDINANCE NO. 20,920 2 3 AN ORDINANCE AMENDING CHAPTER 36 OF THE CODE OF 4 ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, TO 5 PROVIDE FOR MODIFICATION OF THE DEFINITION OF 6 MANUFACTURED HOME; AND FOR OTHER PURPOSES. 7 8 WHEREAS, on September 21, 2010, the Board of Directors passed Ordinance No. 20,326, which 9 included a provision which amended the definition of"manufactured home" to delete the inclusion of 10 factory assembled modular homes from that definition; and 11 WHEREAS, the Board of Directors has determined that it is appropriate to restore the previously- 12 deleted language so that the placement of factory assembled modular homes will have to comply with the 13 Zoning Ordinance requirements of manufactured homes. 14 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 15 OF LITTLE ROCK,ARKANSAS: 16 SECTION 1. That Chapter 36, Section 36-3. be amended to amend the definition of"manufactured 17 home"to include additional language and to read as follows: 18 Manufactured home means a factory-assembled detached dwelling unit with the following 19 characteristics: 20 (1) Designed for full-time occupancy and containing sleeping, bath, and kitchen facilities. 21 (2) Connections for utilities systems provided on the intended site. 22 (3) Designed for highway transport with wheels, chassis, tongue, and other features related 23 to transportability. 24 (4) Conformance with the minimum construction standards of the Federal Mobile Home 25 Regulations of Title VI of Public Law 93-383, USC 5401. 26 This structural type is required to be placed upon permanent foundation supports with anchorage 27 complying with the City's Building Codes. This definition shall be deemed to include modular homes 28 that are factory assembled. This structural type is expressly prohibited in all zoning districts except R-7 29 and R-7A where it is a use by right subject to site plan review, and the R-2, R-3, and R-4 Districts where 30 it is allowed by Conditional Use Permit. 31 SECTION 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, 32 or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 33 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and [Page I of 21 1 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 2 ordinance. 3 SECTION 3. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent 4 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. 5 PASSED: August 19,2014 6 ATTEST.
