3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO APPLY
4 TO THE ARKANSAS STATE PARKS AND TOURISM DEPARTMENT
5 FOR A STATE OUTDOOR GRANT FOR IMPROVEMENTS AT THE BIG
6 DAM BRIDGE RESTROOMS LOCATED IN MURRAY PARK; AND FOR
7 OTHER PURPOSES.

9 WHEREAS, staff of the Parks and Recreation Department has worked with civic and local
10 organizations to develop a plan for improvements at the Big Dam Bridge in Murray Park; and,
11 WHEREAS, the plan includes restrooms, a pavilion and concessions building, a viewing walkway,
12 plaza and seating areas and related support amenities; and,
13 WHEREAS, there is an opportunity to apply to the Arkansas Department of Parks and Tourism for a
14 State Outdoor Grant in an amount up to Two Hundred Fifty Thousand Dollars($250,000.00); and,
15 WHEREAS, Outdoor Grants are administered by the Arkansas Department of Parks and Tourism
16 and funding comes from the Land Water Conservation Fund, which is a 50/50 Match Program; and,
17 WHEREAS, this governing body understands the grantee and grantor will enter into a binding
18 agreement which obligates both parties to policies and procedures contained in the Land and Water
19 Conservation Fund Grants Manual including, but not limited to the following; the park area defined by
20 the project boundary map, submitted in the application, must remain in outdoor recreation use in
21 perpetuity, regardless if the property is bought or developed with matching grant funds; and, all present
22 and future overhead utility lines within the project boundary must be routed away or placed underground;
23 and, the project area must remain open and available for use by the public at all reasonable times of the
24 day and year; facilities can be reserved for special events, league play, etc., but cannot be reserved, leased
25 or assigned for exclusive use; and, the project area must be kept clean, maintained, and operated in a safe
26 and healthful manner; and,
27 WHEREAS, if the U.S. Army Corps of Engineers should determine that they require the land back
28 for their purposes,then land and improvements shall be replaced as per the grant agreement;
29 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
30 OF LITTLE ROCK,ARKANSAS:
31 Section 1. The Board of Directors hereby authorizes the City Manager to submit an application to the
32 Arkansas Department of Parks and Tourism for a state outdoor grant for improvements at Murray Park for
33 the Big Dam Bridge restrooms.

1 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
2 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
3 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
5 resolution.
6 Section 3.Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with
7 the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
