3 A RESOLUTION TO AUTHORIZE USE OF EMINENT DOMAIN ON
4 THE MABELVALE CUTOFF IMPROVEMENT PROJECT; AND FOR
5 OTHER PURPOSES.

7 WHEREAS, the acquisition of right-of-way, permanent construction easements, and temporary
8 construction easements is necessary for the construction of the Mabelvale Cutoff Improvement Project
9 from Shiloh Drive to Mabelvale Main; and,
10 WHEREAS, the apparent heirs to the Norma Fleming Estate cannot show clear title to the property
11 and therefore cannot convey easements to the City; and,
12 WHEREAS, the use of eminent domain will be required to secure permanent and temporary
13 easement;
14 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
15 OF LITTLE ROCK,ARKANSAS:
16 Section 1. The City Manager and City Attorney are hereby authorized to use eminent domain to
17 complete acquisition of permanent and temporary construction easements from the Norma Fleming Estate
18 as necessary for construction of the Mabelvale Cutoff Improvement Project.
19 Section 2. Funding for this project is available from the 2013 Capital Improvement Bonds for Streets
20 and Drainage as authorized by Resolution No. 13,699. Anticipated amount for this acquisition is Two
21 Thousand Dollars($2,000.00).
22 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
23 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
24 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
25 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
26 resolution.
27 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with
28 the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
29 Section 5. This resolution will be in full force and effect from and after the date of its adoption.
