3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO
4 EXECUTE AN AGREEMENT WITH NICK RUFFIN, INC., IN THE
5 AMOUNT OF SIXTY-SIX THOUSAND, THREE HUNDRED NINETY-
6 EIGHT AND 40/100 DOLLARS ($66,398.40), FOR THE EAST 23"
7 STREET DRAINAGE IMPROVEMENTS; AND FOR OTHER PURPOSES.

9 WHEREAS, Bids were solicited for East 23'Street for drainage improvements adjacent to Pettaway
10 Park between 22"d Street and 23rd Street, Project#13-1-01A, Bid Number 14138;and,
11 WHEREAS,Nick Ruffin, Inc.,was the lowest responsive,responsible bid meeting specifications;
12 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
13 OF LITTLE ROCK,ARKANSAS:
14 Section 1. The City Manager is hereby authorized to execute an agreement with Nick Ruffin, Inc. for
15 drainage improvements at East 231d Street near Pettaway Park between 22"d Street and 23' Street.
16 Amount for construction services is Sixty-Six Thousand, Three Hundred Ninety-Eight and 40/100 Dollars
17 (66,398.40), Fifty-Five Thousand, Three Hundred Thirty-Two Dollars ($55,332.00), plus 20%
18 cantingencies.
19 Section 2. Funding for this project is available from the 2012 3/8-Cent Capital Sales Tax Project
20 Funds as authorized by Resolution No. 13,699.
21 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
22 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
23 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
24 e['feet as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
25 resolution.
26 Section 4. Repealer.All laws, ordinances, resolutions,or parts of the same,that are inconsistent with
27 tl�e provisions of this resolution,are hereby repealed to the extent of such inconsistency.

28 Section 5. This resolution will be in full force and effect from and after the date of its adoption.
