9 BRIDGE REPLACEMENT PROJECT; AND FOR OTHER PURPOSES.

11 WHEREAS,the Arkansas Highway and Transportation Department(AHTD) is undertaking a bridge
12 replacement project along State Highway 70, Broadway Street that necessitates the acquisition of real
13 property and permanent and temporary construction easements from the City; and,
14 WHEREAS,AHTD has requested a donation of the property and easements needed from the City to
15 accomplish the construction and, pursuant to Little Rock, Ark. Resolution No. 13,779, certain real
16 property was conveyed by donation to AHTD; however, the legal description of one of the described
17 tracts, namely Tract 4X, of the property authorized for conveyance did not contain the additional property
18 needed for a bus turnout lane on the east side of Broadway Street next to Robinson Auditorium; and
19 WHEREAS,the City Board of Directors has determined that it is in the best interests of the City and
20 its inhabitants for the City to convey the additional property needed by the Arkansas State Highway
21 Commission for the bus turnout lane, which will facilitate the movement of traffic in the area and provide
22 a needed convenience for bus passengers and residents and visitors in the area;
23 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
24 OF LITTLE ROCK,ARKANSAS:
25 Section 1. The Mayor and City Clerk are hereby authorized to execute, in a form approved by the
26 City Attorney, a real estate contract, a deed and any other documents needed to properly convey to the
27 Arkansas State Highway Commission certain lands located in Pulaski County, in addition to those lands
28 already authorized by Little Rock, Ark. Resolution No. 13,779 (October 1, 2013) to be conveyed, so that
29 the correct description of the property conveyed in Tract 4X includes the land for the bus turnout lane on
30 the east side of Broadway Street next to Robinson Auditorium, as more particularly described in this
31 revised Tract 4X description as follows:
32 Tract 4X: Part of Lots 6 and 7 of Block 100 and part of an alley closed by City Ordinance
33 No. 12,471, Original City of Little Rock, Township 1 North, Range 12 West, Pulaski

1 County, Arkansas, more particularly described as follows:
2 BEGINNING at a point being used as the northwest corner of Lot 6 of Block 100 which is
3 also on the southerly right-of-way line of Garland Avenue as established by the Plat of the
4 Original City of Little Rock, Arkansas, recorded as Instrument No. 2010000004; thence
5 south 80° 32' 52" east along said right-of-way line a distance of 22.10 feet to a point on the
6 easterly right-of-way line of U.S. Highway 70 (Broadway Street) as established by AHTD
7 Job No. 061275; thence south 08° 56' 43" west along said right-of-way line a distance of
8 140.01 feet to a point; thence south 03° 45' 26" east along said right-of-way line a distance
9 of 45.48 feet to a point;thence south 08° 56' 43"west along said right-of-way line a distance
10 of 40.00 feet to a point; thence south 16° 28' 34"west along said right-of-way line a distance
11 of 76.30 feet to a point on the northerly right-of-way line of Markham Street as established
12 by the Plat of the Original City of Little Rock, Arkansas, recorded as Instrument No.
13 2010000004; thence north 80° 32' 52" west along said right-of-way line a distance of 24.74
14 feet to a point on the easterly right-of-way line of U.S. Highway 70 (Broadway Street) as
15 established by the Plat of the Original City of Little Rock, Arkansas, recorded as Instrument
16 No. 2010000004; thence north 09° 26' 58" east along said right-of-way line a distance of
17 300.00 feet to the point of beginning and containing 8,026 square-feet, more or less as
18 shown on plans prepared by the AHTD referenced as Job No. 061275.
19 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
20 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
21 adjudication shall not affect the remaining portions of the resolution which shall remain in full force
22 and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a
23 part of the resolution.
24 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
25 with the provisions of this resolution, are hereby repealed to the extent of such inc. sistency.
