3 AN ORDINANCE TO ABANDON AN ALLEY LOCATED ALONG THE
4 NORTHERN PROPERTY LINE OF LOTS 6, 7 AND 8, BLOCK 30 OF CO
5 BRACKS ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS (G-
6 23-445); AND FOR OTHER PURPOSES.

8 WHEREAS, a request was made to abandon a twenty (20)-foot wide and 115 feet long alley which
9 extends from Monroe Street to a north/south alley which extends from Brack Street, pursuant to the City's
10 general police power authority under Ark. Code Ann. § 14-54-104; and,
11 WHEREAS, the Board has determined that the abandonment of the aforementioned easement will
12 not have an adverse impact on the adjacent property owners or the public welfare and safety;
13 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
14 OF LITTLE ROCK,ARKANSAS:
15 Section 1. The Board of Directors hereby releases, vacates, and abandons a twenty (20)-foot wide
16 alley that runs east 115 feet from Monroe Street connecting to a north/south alley which extends from
17 Brack Street.
18 Section 2. The alley will be abandoned as a public right-of-way; however, it will be maintained as a
19 drainage and utility easement.
20 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
21 records of the recorder of the Circuit Clerk in ex-officio recorder of Pulaski County, Arkansas.
22 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
23 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
24 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
25 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
26 of the ordinance.
27 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
28 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
